Welcome
The Chair welcomed all participants and expressed his pleasure to host this seventieth Stakeholders Group (SG) meeting. He also thanked all the participants in general, but specially TSOs, for their efforts to progress in the projects included in the SGRI work plan, and encouraged shippers to continue contributing with their proposals, comments and participation.

Approval of the agenda and minutes from the last meeting
The minutes from the last meeting were approved with no changes.
Gas Natural asked to include in the agenda the information on the balancing zones merging process in France. The French regulator will provide a clarification in this meeting.

CAM harmonization
II.1. CAM NC pilot project to be applied between Portugal and Spain
Regulators inform that one of EC’s current priorities is the Roadmap on capacity allocation, including the pilot CAM projects and the IT platform. They also, welcomed the progress achieved by Spanish and Portuguese TSOs regarding this project.
TSOs presented the results of the coordinated auction process between Spain and Portugal. In particular, they explained that some shippers were prequalified but no one was accredited as qualified to participate neither in the firm yearly products auction nor in monthly products auction. Therefore, no firm capacity was allocated in the process. Consequently, no interruptible products auctions took place. They clarify (by request from the floor) that at the beginning there was contractual congestion at Badajoz, but during the process some shippers cancelled the contracts and congestion disappeared.
Regulators presented the auction procedure and its evaluation, in line with TSOs presentation.
The Chair invited. Since the procedure will be launched again next year, participation showing market needs is important in the process.
Stakeholders noted that the capacity products duration were not interesting for them, because they consider yearly products are not attractive to buy. Furthermore, the price product (reserved price + premium) did not incentive participation.
The Chair encourages all participants, NRAs and TSOs to continue progressing on Spain and Portugal harmonization on CAM.
II.2. Coordinated CAM Spain-France.
The TSOs presented the work to be done to launch the next yearly OSP. They consider Regulators must decide next steps on how and what should be sold in the interconnections between Spain and France in order to progress towards the CAM NC provisions. They pointed out that new capacity allocation platform is a critical point.
French regulator explained the process of balancing zone merging. It has been a large process including intensive public consultations. A decision was adopted in July on the elaboration of a roadmap. The first goal consists in the creation of a single area in the South including GTRgaz Sud and TIGF (by 2015). The full merging by 2018 is considered expensive according the studies on cost estimations made by GTRgaz, because involves infrastructure development. GRTgaz reminds that a Workshop will be held in Paris, on the 2nd October, to explain in detail the merge in the South.
In relation to the next OSP, CRE favours launching the next Fr-Sp OSP as planned, selling capacity from March 2013 to April 2014, with the pro-rata allocation; then it will be possible to launch a CAM selling capacity for 6 months, till September 2014 to harmonize the products to CAM NC requirements. This could allow TSOs to have the capacity platform ready, not later that the auctions for October 2014.
ENAGAS is analyzing the options to join the CAM platform, attending all the meetings and WS. They will inform Regulators when the decision on joining the platform is taken. TIFG says to be working in collaboration with ENAGAS and they will take a decision shortly.
Regulators informed on agreements reached in the last RCC on this issue, to elaborate along 2013 a Roadmap on CAM harmonisation in the South Region to be ready to implement it in 2014. They requested TSOs to continue working in the harmonization of CAM in the SGRI. The aim is that by October 2014 the CAM NC will be implemented in the entire region.
II.3. North West Capacity Allocation platform.
The Joint Capacity Platform Initiative was presented. They will merge existing capacity platforms to build a European-wide Platform. Mainly, it allows TSOs to allocate primary and secondary capacity products for interconnections and other points. The CMP requirements have been also considered. They will implement the NC CAM starting for the short term products. They explained that there are several possibilities for TSOs to join the initiative. Finally, they informed that a TSOs’ workshop will be held in Brussels on the 4th -5th October.
Stakeholders’ comments were focused on the clarification of the products that will be allocated through the capacity platform. In addition, a question was asked about including LNG terminals in the allocation process. At the moment, only interconnection points at transmission networks are considered, nominations are not envisaged in the short term.
The French ministry advice is to act carefully since the CAM NC has not been approved yet. Furthermore, a request for keeping some flexibility on board was made.
Regulators support TSOs to join the NW platform as soon as possible. In other to achieve this, Portuguese, Spanish and French TSOs must participate in the development of the Joint Capacity Platform Initiative discussions on early CAM NC implementation.

CMP
III.1. Implications of new regulation on CMP
Regulators presented the implications of the regulation recently approved, on the CMP guidelines, i.e. EC Decision amending Annex I of Regulation (CE) 715/2009. The four mechanisms were briefly explained. Three of them: oversubscription and buyback (OSBB), surrender of contracted capacity and LT UIOLI must be implemented before October 2013. The deadline of the firm day-ahead UILOI implementation is July 2016.
ENAGAS outlined the amount of work to be done regarding the implementation of the three mechanisms. implementation of OSBB (to be proposed by TSOs and approved by NRAs) could interfere in the CAM platform development.
French TSOs informed that they have already started to work on this task. They presented the first draft principles for implementation of surrender of capacities. Also, they encouraged ENAGÁS and REN to join them and to continue working on CMP implementation.
The TSOs will develop a detailed plan on CMP harmonization (Roadmap: agenda, milestones, calendar, etc.), to be presented in the next IG meeting planned on 6 November.

Ten-Year Network Development Plan and Project of Common Interest (PCI)
IV.1. Status Record OS 2013-2015
ENAGÁS explained that the pipeline Zarza de Tajo-Yela is beginning construction. They estimate that there will be a delay: the capacity will be available at the end of 2013. They’re going to review the situation with TIGF and will analyze if the services will be still provided, reporting on this in the following weeks. They inform the next bilateral meeting on this subject will be held on 4 October.
ENAGAS and TIFG will provide final figures on available capacity in 15 days and Stakeholders will informed.
IV.2. Update on PCI Identification
Regulators presented the update on PCI identification in the North West corridor: the working group formed by Governments, NRAs and infrastructure promoters of 11 European countries. The TYNDP and the GRIP are the starting points to select PCIs, although other infrastructures may be analysed. They also informed about the content and conclusions drawn in the three meetings held in the past. The next meeting will take place on 28th September in Brussels on the presentation of the preliminary results of the PCI assessment.
Regulators will prepare a common position on the SGRI GRIP to be provided to ACER, as requested.

Study on tariff between Spain and Portugal
The conclusions of the public consultation on CNE-ERSE’s joint study on tariff regimes in Spain and Portugal were presented by Regulators. The summary of comments of the stakeholders is already published. Each country will be working in developing a national entry-exit system following European guidelines. The Spanish regulator is working on a methodology proposal, which will be released to public consultation in the following weeks. A common task of tariff harmonization proposals shall be initiated after these national regulatory processes, during 2013.

Transparency (compliance with Regulation 715/2009)
VI.1. Final Report on the Supervision of Compliance
Regulators presented the Final Report on the Supervision of compliance with the transparency requirements in the Regulation 715/2009/CE. In general, a high level of compliance is reported on all provisions regarding TSOs. However, according to the NRAs’ assessment and stakeholders’ comments (only 5 received in the Public Consultation), in some TSOs’ websites the relevant information is not easy to find and there is room for improvement in frequency of publication, historical data and information published in English.
In relation to LSOs and SSOs in the South Region, some of their websites reflect the available information, mainly on service description, contracted and available storage facility capacity, use and availability of TPAs services and form of publication. Nevertheless, it is necessary to improve in easy, direct access and friendly manner to publish the relevant information.
The Report has been made by Regulators and submitted to ACER to be presented in next Madrid Forum. ENAGÁS said that the supervision must be restricted to the provisions in Regulation, especially referred to publishing the information in English. REN also remarked the possible misunderstandings since the criteria of its implementation are not clearly defined.
NRAs will supervise that the national TSOs implement the transparency requirements missing.

Review of the Work Plan 2011-2012
Regulators revised the progress and state of art of the rest of projects included in the Work Plan (SoS, balancing, tariffs after national arrangements, hub development and interoperability)
The Spanish regulator is committed to develop the regulation needed to create a hub in the following months.

AOB and next meetings
A question was launched by a stakeholder regarding the scope of the GRIP drafting, in particular if the LSOs and SSOs are incorporated. Regulators explained that in Spain the approach is common and include all the infrastructures. Any participation of other infrastructures’ promoters is welcome, but regulation applies only to transmission networks. TSOs commented that GRIP has been developed by TSOs according to Regulation, but they would take into consideration other projects’ proposals.
REN remarked the efforts made by TSOs on the Sp-Pt auction, and they request shippers’ participation for improving the process, encouraging them to send comments. CNE congratulates TSOs for the work done.
EFET requested the harmonization on information to be published by operators to facilitate switching. They propose to work also on this point that it is not included in the South Region Work Plan. French regulator informed about the existence of a French working group on this issue.
