Offences relating to work-related deaths and serious injuries
Current arrangements
Under existing Australian OHS laws, non-compliance with a duty of care that results in a work-related fatality may lead to the imposition of a penalty for that offence. The laws impose a variety of discrete or additional penalties in circumstances where such a fatality has occurred. As noted earlier, in some jurisdictions, specific offences relating to causing a work-related fatality have been created, including in the Crimes Act 1900 (ACT).295 Generally speaking, this is a relatively recent development.
