Against this background, the first and second options (providing for the continuation of the current legislative approach in most jurisdictions) are not likely to satisfy the principles set out in paragraph 14 of the terms of reference, particularly those relating to:
ensuring that there be “no reduction or compromise in standards for legitimate safety concerns.”
The first and second options may over time lead to a reduction in the protection of health and safety, by failing to respond to change and leaving significant groups of persons unprotected by the law.
Accordingly, we do not support the first and second options.
