3 Establishment of South African Qualifications Authority

There is hereby established a juristic person called the South African Qualifications Authority.
13 Auditing and annual report
(1) The books of account and financial statements of the Authority shall be audited at the end of each financial year by the Auditor-General.
(2) The Authority shall not later than six months after the end of each financial year submit to the Minister a report in such form as the Minister may determine on its functions during that financial year, including an audited balance sheet and a statement of income and expenditure.
(3) The Minister shall table copies of the report, including the balance sheet and statement of income and expenditure referred to in subsection (2), in Parliament within 14 days after the receipt thereof if Parliament is in ordinary session, or, if Parliament is not in ordinary session, within 14 days after the commencement of its next ensuing ordinary session.

1 Definitions
'Governor' means the person appointed under section 4 or 6(1) (a) as the Governor of the Bank;
4 Board of directors
(1) The Bank shall be managed by a board of fourteen directors, consisting of-
(a) a Governor, three Deputy Governors (of whom one shall be designated by the President of the Republic as Senior Deputy Governor) and three other directors, which Governor, Deputy Governors and other directors shall be appointed by the President of the Republic after consultation with the Minister and the Board; and
(b) seven directors elected by the shareholders.
4A. Functions and powers of Board
(1) The Board shall be responsible for the corporate governance of the Bank by—

(a) ensuring compliance with principles of good corporate governance;

(b) adopting rules and determining policies for the sound accounting, administration and functioning of the Bank;

(c) approving the—

(i) budget of the Bank;

(ii) annual reports and financial statements of the Bank required for submission to the meeting of shareholders, the Minister and Parliament;

(iii) appointment or the termination of service of a secretary and an assistant secretary of the Bank;

(iv) general remuneration policy of the Bank; and

(v) allocation of funds to the retirement fund of the Bank for purposes of making good any actuarial shortfall as well as the appointment of any employees’ trustee in respect of such fund;

6 Casual vacancies
(1) A casual vacancy on the Board shall be filled-
(a) in the case of the Governor or a Deputy Governor or of a Government representative, by the appointment by the President of the Republic of another person after consultation with the Minister and the Board; and

(4) The Minister shall within fourteen days after the date of publication in the Gazette of a notice issued under subsection (2), lay a copy thereof upon the Tables in Parliament, if Parliament is then in ordinary session, or if Parliament is not then in ordinary session, within fourteen days after the commencement of its next ensuing ordinary session.

(3) The Minister shall within fourteen days after receipt thereof lay a copy of the report referred to in section 31 and of every financial statement or list received in terms of paragraph (b) or (c) of subsection (1) upon the Tables in Parliament, if Parliament is then in ordinary session, or if Parliament is not then in ordinary session, within fourteen days after the commencement of its next ensuing ordinary session.

South African Roads Board Act 74 of 1988

2 Establishment of South African Roads Board

(1) There is hereby established a board to be known as the South African Roads Board.
18 Annual report
(1) The Board shall as soon as practicable after 31 March of each year but not later than 31 December of that year submit to the Minister a report (hereinafter referred to as the annual report) giving particulars regarding the activities of the Board and of each committee during the year which has ended on the first-mentioned date.
(2) The Board shall in the annual report make specific mention of any matter in connection with which any recommendation made by the Board or a committee to the Minister during the relevant year was not acted upon.
(3) The Minister shall lay a copy of the annual report upon the Table in Parliament within thirty days after it has been received by him if Parliament is then in session, or, if Parliament is not then in session, within thirty days after the commencement of its next ensuing session.

South African Social Security Agency Act 9 of 2004

2 Establishment of Agency

(1) The South African Social Security Agency is hereby established as a juristic person.

(2) The Agency is subject to the Public Finance Management Act, 1999 (Act No. 1 of 1999).

17 Dissolution of Agency

The Agency may not be dissolved except in terms of an Act of Parliament.

South African Transport Services Conditions of Service Act 41 of 1988

8 Establishment, objectives and functions of Labour Council

(1) A Labour Council of the South African Transport Services is hereby constituted.
(2) The objectives of the Labour Council shall be-
(a) the maintenance and promotion of labour peace; and
(b) the prevention of labour disputes.
(3) The functions of the Labour Council in pursuance of its objectives shall be-
(a) collective bargaining and the conclusion of agreements as referred to in section 15 in connection with conditions of service and salaries of employees occupying grades represented by trade unions, as well as matters related thereto;
(b) the referral, subject to the provisions of subsection (5), to mediation, arbitration or other dispute conciliation or settlement procedure which it may deem appropriate, of any matter which was the subject of collective bargaining in terms of paragraph (a) and in respect of which it was unable to conclude an agreement as referred to in section 15; and
(c) the investigation of, and submission of recommendations in connection with, matters referred to in paragraph (a), including, notwithstanding the contents of subsection (4) (b), the representation of employees by particular trade unions, upon receipt of a written request from a trade union, the Minister or the South African Transport Services to do so.
(7) The Labour Council shall be responsible to the Minister for the achievement of its objectives and the exercise of its functions. The Chairman of the Labour Council shall frame annually and submit to the Minister a report on the Labour Council's activities during the previous 12 months. Every such annual report shall be laid upon the Table in Parliament by the Minister within 21 days after it has been received by the Minister, if Parliament is then in session or, if Parliament is not then in session, within 21 days after the commencement of its next ensuing session.
