This visa’s requirements

Below are the requirements you must meet to be eligible for this visa. You must provide evidence of each of the requirements with your application.



  • You must be less than 55 years old (except where the regional authority considers that the proposed business will be of exceptional economic benefit to the region).

  • You have an overall successful business career.

  • You must be sponsored by an appropriate regional authority of a State or Territory Government.

  • You (and your spouse combined) had net assets in a qualifying business of A$400,000 for at least two (2) of the four (4) fiscal years immediately before you apply.

  • The annual turnover of your main business (or two main businesses combined) was at least A$3,000,000 in at least two of the four fiscal years immediately before you apply.

  • Your (or your and your spouse's) total assets have a net value of at least A$1,500,000, and were legally acquired and are capable of being transferred to Australia within two years of being granted this visa.

  • You (or your spouse) have never been involved in unacceptable business activities.

  • You have a commitment to maintain an ownership interest in a business in Australia and direct and continuous involvement in the management of that business.

  • You must meet certain health requirements and may need to undergo a health examination.

  • You must be of good character for you to enter Australia.

  • From 15 October 2007, if you are aged 18 years or over, you are required to sign an Australian values statement as part of your visa application.

Eligible family members

Your family members must meet the following requirements to be eligible for this visa. Evidence of each of the requirements must be provided with your application. You can include the following people in your application for this visa.



  • your spouse

  • your or your spouse's dependent children

  • other dependent relatives living with you.

If your child is born after you lodge your application (but before a decision has been made) the child can be added to your application, once you notify the department of the details of the newborn child. You can also request in writing for a dependent child to be added to your application. Your spouse can apply separately as long as your visa has not yet been granted.


All family must meet certain health requirements and may need to undergo a health examination. All family members must be of good character for you to enter Australia.

Obligations

After you enter Australia you must either:



  • establish a qualifying business in Australia

  • participate in an existing qualifying business in Australia

In that business you must:



  • maintain a substantial ownership

  • maintain direct and continuous involvement in the day-to-day management of that business

  • make decisions that affect the overall direction and performance of the business in a manner that benefits the Australian economy.

You must also:



  • Notify the department of your residential address by completing Form 992 within 6 months of your initial entry to Australia and continue to notify the department of any subsequent changes of address within 28 days of the change including any residential address outside Australia.

  • Accurately and fully complete a survey of your business activity in Australia. Form 1010 Survey of Business Skills visa holders will be sent to the address that you provide the department.


You and your family must also abide by all Australian laws as permanent residents.
If your circumstances change you must inform the department (in writing) as soon as possible.

Applying for this visa

There are two steps in the application process for this visa. You need to complete each step before progressing to the next.


Step 1 - Apply for Sponsorship

Before you apply for this visa, you must gain sponsorship from the regional authority in the State/Territory in which you intend to go into business. The table below shows the process which you need to complete to notify the appropriate regional authority.

Step 2 - Complete and lodge your application

You must be outside Australia when this visa is granted, unless you held a student visa at the time you applied.


Your visa is linked to the passport number you used in your application and you must use the same passport to travel to Australia. If you do obtain a new passport, you must advise the department of the new passport details before you travel to Australia. Otherwise, you will experience significant delays at the airport and could be denied permission to board your plane.
If you are invited to an interview, you must attend on the agreed time and date. If you do not, the department will make a decision on the basis of the information it already has.
If another person gives the department information that could result in you being refused a visa, the department will give you an opportunity to comment on the information. You will need to comment by a set date.
You can lodge your application:

  • by mail

  • by courier

  • in person

  • by fax

How you complete and lodge your application will depend on where you live. There are separate processing offices for applicants from People's Republic China, Korea or Taiwan, but all other nationalities have to lodge their application at the Perth Business Skills Processing Centre.

If you have an enquiry about applying for this visa you can contact the Perth Business Skills Processing Centre.

Your application must include the application forms, and all necessary documentation. You must pay a non-refundable visa charge when you lodge your visa application.


There may be additional costs, such as those required for a character clearance from authorities in your country, and the cost of certified translations of documents.


Complete the application form and the Business Skills profile form below and attach all necessary documentation. Form 47BU: Application for a Business Skills (permanent) visa http://www.immi.gov.au/allforms/pdf/47bu.pdf

You might be asked to provide additional information to that provided in your application. You will be given a date by which you will have to provide the information and the department will continue processing your application after that date. You cannot delay a decision by saying you may or will give information at a later date.
