6.00 MILITARY LEAVE 6.01 Paid Military Leave Employees are entitled to receive their regular pay while performing certain duties in the armed forces of the Commonwealth. An employee shall be entitled to receive pay during the time of his/her service in the armed forces of the Commonwealth during the circumstances outlined in M.G.L. Chapter 33, §§ 38, 40, 41, or 60. Employees shall present their signed, official military orders to their agency or department head.
Employees are entitled to receive their regular pay from the Commonwealth while performing their annual tour of duty (ATD). State employees are entitled to receive regular pay not exceeding thirty-four (34) days in any state fiscal year and not exceeding seventeen (17) days in any federal fiscal year during their ATD.
Such employees shall also be entitled to the same leaves of absence and vacation with pay given other employees under Chapter 33, §59.
