3 Precedent for Statutory Reform of Tort Law and Vicarious Liability
Legislative intervention in the common law of tort is not new,¹⁴⁰ and has since the 19 century been used in various discrete areas to extend tortious liability,^th or in some instances to augment the common law by way of statutory schemes¹⁴¹ or codes.¹⁴² It is also noteworthy that there are precedents for specific statutory reforms to the common law of vicarious liability.¹⁴³ In these circumstances, there are strong reasons to consider statutory reform in Australia to provide a comprehensive package of reforms to assist survivors.
