Duties


The Office of the General Counsel is responsible for all legal services and advice required by the department. This includes the coordination of legal services and the provision of internal legal advice including contracts and grants management, statutory interpretation and regulatory advice, legislative development, debt recovery, investigations and enforcement and litigation and claims resolution. It also manages and advises on matters relating to Freedom of Information and privacy.
The Job

In these roles, you will contribute to reducing the department’s legal risk through the delivery of accurate and appropriate legal service. Successful candidates will work collaboratively within teams under the supervision of Senior Government Lawyers.

These positions would suit lawyers in their first few years of legal practice. Knowledge and Experience

Successful candidates will be able to demonstrate knowledge and experience in the provision of legal services in one or more

of the following areas:


  • Statutory Interpretation

  • Administrative Law

  • Commercial Law

Eligibility


Mandatory Qualifications

To be eligible for these positions you are required to hold a degree in law and be eligible to hold an ACT legal practising certificate.


These positions require a Baseline level security clearance. The successful applicants will be required to obtain and maintain a clearance at this level. To be eligible for employment with the Department of Agriculture and Water Resources, an applicant must be an Australian Citizen. An applicant's suitability for employment with the department will be assessed through a pre- employment screening process. This process includes a requirement for the applicant to undergo and satisfy a National Police Check, referee checks, character clearance and where relevant a pre-employment medical assessment, specified mandatory qualification(s) validation and a period of 6 months' probation. Any applicant that, in the course of their work, requires unescorted access within an aviation or maritime security zone will be required to obtain and maintain an Aviation Security Identification Card (ASIC) or Maritime Security Identification Card (MSIC).

Duties


The Assistant Director, Alternative Dispute Resolution (ADR) assists in coordinating and promoting the use of high quality alternative dispute resolution as an integral part of review processes at the Administrative Appeals Tribunal (AAT). The position supports the Director ADR in development initiatives for process improvement, stakeholder engagement and change management in ADR. In addition to these key functions, the Assistant Director, ADR will also conduct less complex conferences and alternative dispute resolution processes in the Brisbane Registry.
This is a new role and will be subject to modification based on the strategic and operational priorities of the AAT.

Eligibility


  1. The successful candidate will possess a recognised degree in Laws from an Australian tertiary institution, hold a comparable overseas qualification, or be admitted as a practitioner to the High Court or Supreme Court of an Australian State or Territory.




  1. Accreditation as a mediator under the National Mediator Accreditation System is a requirement of this position.




  1. The successful candidate will be required to obtain a Baseline security clearance as a condition of employment.



Notes


This position attracts a 2% conferencing allowance.
This position may be offered as ongoing or non-ongoing (temporary), and on a full time or part time basis dependent upon the needs of the successful candidate and the operational needs of the AAT.
Non-ongoing opportunity will be offered for a specified term
If the position is filled on a non-ongoing basis, it will initially be offered for a period of up to 12 months, with a possibility of extension of up to three years.

About Administrative Appeals Tribunal
The Administrative Appeals Tribunal (AAT) has offices located in all states of Australia and the Australian Capital Territory and provides independent review of a wide range of administrative decisions made by the Australian Government, some non- government bodies and the Norfolk Island Government.
On 1 July 2015 the Migration Review Tribunal, Refugee Review Tribunal and Social Security Appeals Tribunal were merged with the AAT. The amalgamated AAT comprises a number of Divisions: Social Services and Child Support, Migration and Refugee, and General and Other.
