Subject: ADB Loan No. 3903-UZB: “Sustainable Solid Waste Management Project”
Contract: No. SCEEP/QCBS-CS2 from 22.03.2022 – Notification about suspension
Dear Mr. Raphael Berdugo,
As you are aware, as part of the reforms and according to the Decree of the
President of Uzbekistan No. 269 from 21.12.2022 the new Ministry of Natural
Recourses has been established based on the State Committee of Uzbekistan of
Ecology and Environmental Protection. Then, referring to the Decree of the
President of Uzbekistan No. 81 from 31.05.2023 the Ministry of Natural Recourses
has been renamed as the Ministry of Ecology, Environmental Protection and Climate
Change (the Ministry) with additional tasks and responsibilities.
All these are significant changes in the legal and institutional framework of
the Solid Waste Management sector, which shall be considered in the ongoing
ADB’s Sustainable Solid Waste Management Project and duly reflected in the scope
of service of the ongoing Consulting service contracts of the Project.
As executing agency, Ministry has intention to reconsider carefully the
present Terms of References of the Consultants, including your ToR under the
Contract No. SCEEP/QCBS-CS. Because, in our opinion, the recent legal and
institutional reforms in the SWM sector and among the Governmental agencies
makes the Consultant’s further performance of its obligations under the present
Terms of Reference not reasonable and impractical. We will discuss this subject
during the Project review mission of ADB scheduled for November 2023.
In this regard, we kindly ask you to suspend the provision of the Consultant
services under the Contract starting from the date of this notification.
