Verification of the works by the Engineer with a view to provisional or final acceptance shall take place in the presence of the Contractor. The absence of the Contractor shall not be a bar to verification on condition that the Contractor has been summoned in due form at least 30 days prior to the date of verification.
Should exceptional circumstances make it impossible to ascertain the state of the works or otherwise proceed with their acceptance during the period fixed for provisional or final acceptance, a statement certifying such impossibility shall be drawn up by the Engineer after consultation, where possible, with the Contractor. The verification shall take place and a statement of acceptance or rejection shall be drawn up by the Engineer within 30 days following the date on which such impossibility ceases to exist. The Contractor shall not invoke these circumstances in order to avoid his obligation to present the works in a state suitable for acceptance.
The works shall not be accepted until the prescribed verifications and tests have been carried out at the expense of the Contractor. The Contractor shall notify the Engineer of the date on which such verification and tests may commence.
Works which do not satisfy the terms and conditions of the Contract, or in the absence of such terms and conditions, which are not carried out in accordance with trade practices in the Federal Democratic Republic of Ethiopia, shall, if required, be demolished and rebuilt by the Contractor or repaired to the satisfaction of the Engineer, otherwise this shall be done as of right after due notice at the expense of the Contractor, by order of the Engineer. The Engineer may also require the demolition and reconstruction by the Contractor, or repair to the satisfaction of the Engineer, under the same conditions of work, in which unacceptable materials have been used, or carried out in the periods of suspension provided for in GCC Clause 20.
