Death: 18 Apr 1966, Kansas City MO

Father: Lazor Abrookyn Brooks (1854-1938)

Mother: Michle Shimme (Celia) Levine (~1858-1931)
Chana “Anna” Brooks was a descendant of Avram Levine, brother of Benjamin’s father Moishe and of Rochel Hode Sutin, his father’s half-sister.
When Benjamin was born Lapitz had 100 Jewish families, 150 Christian families. At age 11 Benjamin went to Smilovichi from Lapitz to learn to be a tailor. Because of poor family financial conditions, it was necessary for him to learn a trade at an early age to help support the family. Thus the only education he received as a child was the Hebrew instruction given in preparation for his Bar Mitzvah, in 1893 in Smilovichi. He remained in Smilovichi for five years, living with his Uncle Gedalia and Aunt Malke or with his Aunt Heshe/Eshe Raza Axelrod. Benjamin then went to Skobrovka, where he became a good tailor and worked steadily. Ben gave his occupation as a self-employed tailor on his World War I registration card.
After marrying, Ben and Anna decided to leave Russia for the U.S. They went from Skobrovka to Minsk just ten days after their marriage, traveling by way of Germany. They arrived in the U.S. 15 February 1901 on the SS Noordland from Antwerp. The ship‘s passenger record lists her age 16, although according to other sources she would have been 20. To get to the ship they paid an agent 100 rubles to bribe a border guard and smuggle them to a location where they could get a boat. The 100 rubles included their passage (presumably by steerage) from Antwerp to New York. Anna’s father, who was then in Kansas City MO, sent them railroad fare from New York to Kansas City.

Birth: 6 Jun 1908, Kansas City MO

Occupation: Attorney, judge of New Mexico Court of Appeals

Marriage: 30 Sep 1929.
Lewis grew up in Kansas City and was working by age 10, selling newspapers downtown and caddying at the local golf club.  At age 13, he gave a speech at his elementary school graduation and thus began his life-long love of oration and debate.  While in high school he changed his name to Lewis Randolph.
While at the University of Illinois, Lewis washed dishes and waited tables at his fraternity for room and board. He met Eloise in May 1926, and they began dating a year later when she enrolled at the University of Illinois and Lewis was a first year law student. They married while he was still in school.  He received his law degree in 1931 and was admitted to practice in Indiana. In 1937 he became chief prosecuting attorney, was defeated in the next primary, and became assistant city attorney in 1938. In the following years he became president of District 2 B’nai Brith, was active in politics and president of many organizations, and travelled extensively—but couldn’t earn a decent living.
Thus in 1945, after 15 years of practicing law and politics in Terre Haute, Lewis packed up the family and moved to Albuquerque NM where he re-started his law practice. As a trial lawyer, Lewis was a master of litigation and argument before judges and juries. He was appointed to the New Mexico State Appellate Court in 1971 by the governor and re-elected in 1974. At the swearing in ceremony, his two daughters-in-law (Esther and Malka Sutin) assisted him in putting on his judicial robe for the first time.  In his memoirs, he refers to this ceremony as “the greatest thrill in my life so far.” Because of his number of dissenting opinions, he labeled himself the “Great Dissenter.” He is remembered as a highly respected and successful lawyer, and a humanitarian and philosophical judge.
He also is remembered as being quite eccentric in his later years. He always was dressed impeccably in fine tailored suits (made by his father, Benjamin), with a long white beard, flower in his lapel, bowler hat, walking stick, cigar, and a glass of scotch.  A portrait of him hangs in the lobby of the La Fonda Hotel in Santa Fe where he led daily “round table” discussions, sharing wit and wisdom with fellow lawyers.
A considerable amount of information about Judge Lewis Sutin, including his papers, is available at the Jacob Rader Marcus Center of the American Jewish Archives in Cincinnati OH.
