and the State President proclaims the following law:


About the Constitution (Satversme) of Daugavpils University

Article 1. On March 5th 2001 Daugavpils University Constitution (Satversme) adopted by Daugavpils Pedagogical University is confirmed by this law.


Article 2. The law comes into legal force the next day after its proclamation. Together with the law Daugavpils University Constitution (Satversme) is proclaimed.
Article 3. The law “About the Constitution (Satversme) of Daugavpils Pedagogical University” loses its legal force with coming into legal force of this law.
The law is adopted at the Parliament (Saeima) on October 4th 2001.

THE CONSTITUTION (SATVERSME) OF DAUGAVPILS UNIVERSITY
PREAMBLE
Daugavpils University history begins with November 1921 when pedagogical school was opened in Daugavpils during independence of Latvia and systematic foundation was laid for training teachers in Latgale. The Pedagogical school was later renamed as Teachers’ Seminary, but on August 1st 1923 as Teachers’ Institute. In 1952 Daugavpils Teachers’ Institute was reorganized as a higher educational establishment – Daugavpils Pedagogical Institute (DPI).
On February 22nd 1993 Daugavpils Pedagogical Institute was renamed as the Daugavpils Pedagogical University by the order No78 of the Minister of Education of the Republic of Latvia. The Constitution (Satversme) of Daugavpils Pedagogical University was adopted by the higher school Constitutional (Satversme) meeting on March 15th 1993. The Constitution (Satversme) was confirmed by the law “About Constitution (Satversme) of Daugavpils Pedagogical University” on April 10th 1997. Daugavpils Pedagogical University Constitutional (Satversme) meeting adopted Daugavpils University Constitution (Satversme) on March 5th 2001.


  1. GENERAL REGULATIONS




  1. Daugavpils University is the state establishment of an academic and professional higher education of the Republic of Latvia situated in Latvia and serving its interests.

The shortened name of Daugavpils University is DU.

Its name in other languages is:

Universitas Daugavpiliensis (in Latin)

Daugavpils University (in English)

Universität Daugavpils (in German)

Даугавпилский университет (in Russian)

Université de Daugavpils (in French)

Daugpilio Universitetas (in Lithuanian)

Daugavpilsi ülikool (in Estonian).

The legal address of Daugavpils University is 13 Vienības street, Daugavpils, Latvia.



  1. Daugavpils University is a juridical person. Daugavpils University is founded by the state, and it operates as an autonomous self-government establishment.

The decision about the reorganization or liquidation of Daugavpils University is adopted by the Cabinet of Ministers on the proposal of the Ministry of Education and Science.

  1. Self-government of Daugavpils University is based on the rights of the staff and possibilities to participate in the adoption of academic and scientific, administrative and economic decisions.

Daugavpils University functions on the basis of the Constitution (Satversme) of the Republic of Latvia, the Law of Education, the law “About scientific activity”, the law of Higher Schools, Daugavpils University Constitution (Satversme) and other normative acts.

  1. Daugavpils University has its own seal with the small coat-of-arms of the Republic of Latvia and insignia: The Republic of Latvia, Daugavpils University.

  2. Daugavpils University has its own banner, coat-of-arms and hymn. The description of the symbols and the order of their use are determined by the Rules confirmed by the Senate.




  1. MAJOR DIRECTIONS AND TASKS




  1. Daugavpils University is a regional centre of education and science combining and developing the main potential of studies and research in the branches of natural, social and educational sciences and the humanities in Eastern Latvia. The task of Daugavpils University is to ensure high quality studies and scientific research corresponding to modern level forming the intellectual basis for the harmonic development of the region.

  2. Daugavpils University organizes its work in the interests of the public, informs the society about its activities, about the directions of studies and scientific research and the possibilities, offers to the public the obtained scientific, artistic and professional ideas, methods and the results of the research.

  3. Daugavpils University creates preconditions for carrying out the scientific research work and for obtaining scientific degree. Daugavpils University takes care for the preparation of young scientists, gives the possibility to scientists to integrate in international science.

  4. The main tasks of Daugavpils University are:

    1. to function as a regional University in the branches of natural, educational and social sciences and the humanities creating the possibilities for comprehensive, high level studies and research;

    2. to offer qualitative study programmes and carry out research in accordance with the development of the demands of labour market and the requirements of the society;

    3. to create possibilities for raising the professional mobility of the inhabitants by developing further education;

    4. to develop personality that is able to think analytically, to perceive critically and to process creatively information, who can promote the development of the Latvian state and the region and raise welfare of the inhabitants with the help of his/her education;

    5. to preserve and develop the national identity and cultural heritage of the Latvian nation, at the same time integrating in the international society.




  1. PRINCIPLES OF ACTIVITY AND COMPETENCE




  1. The activity of Daugavpils University is based on the following principles:

    1. freedom of cognition, studies and scientific work: free choice of study courses, programmes and the contents and methods of scientific work, free expression of one’s scientific point-of-view and the results of research, if this freedom does not contradict the norms of ethics, the rights of other persons and the legislation of the Republic of Latvia;

    2. unity of studies and scientific work;

    3. coordination of studies and scientific work with the needs and requirements of the public.

  2. In connection with the studies and scientific work Daugavpils University has the rights:

    1. to determine independently the contents and form of the study programmes, additional regulations of students enrolment, the order of immatriculation, as well as the main directions of Daugavpils University scientific work;

    2. to confer scientific degrees, to confer qualification, to issue corresponding Daugavpils University diplomas recognized in the Republic of Latvia;

    3. to conclude agreements with other educational and scientific establishments in Latvia and abroad;

    4. to participate in national and international foundations and projects;

    5. to open representation offices and affiliated branches;

    6. to organize congresses, conferences and other meetings;

    7. to carry out entrepreneurship activity;

    8. to found foundations, societies;

    9. to announce competitions;

    10. to organize courses and lectures.

  3. Daugavpils University independently determines its organizational and administrative structure, forms its own staff.

  4. Daugavpils University determines and confirms its inner routine by the decision of the Senate.

  5. Daugavpils University gives a possibility to obtain academic and professional higher education for the citizens of Latvia and persons having the passport of non-citizen of Latvia, irrespective of their gender, social and property situation, race and nationality, political views and religion. Foreigners have also the right to study at Daugavpils University.




  1. DAUGAVPILS UNIVERSITY REPRESENTATIVE, ADMINISTRATION AND DECISION MAKING INSTITUTIONS




  1. The representative, administrative, and decision making institutions of Daugavpils University are:

    1. Constitutional (Satversme) meeting;

    2. Senate;

    3. Rector;

    4. Inspection commission;

    5. Arbitration court.

  2. Administrative management of Daugavpils University is also ensured by:

    1. Pro-rectors;

    2. Executive director;

    3. Director;

    4. Study Board;

    5. Science Council;

    6. Economy Board.

  3. Constitutional (Satversme) meeting is Daugavpils University higher collegiate authorized institution of representation, administration and decision making which is elected for three years by closed voting from professors and other academic staff – 140 representatives (70%), students – 30 representatives (15%) and general staff – 30 representatives (15%).

    1. If the elected representatives break their working (study) relations with Daugavpils University, then, other representatives from the corresponding group of staff are elected within three months;

    2. The delegate of the Constitutional (Satversme) meeting is recalled by the meeting of that group of the staff which has elected him/her. The decision of the staff group meeting is to be submitted to Daugavpils University Constitutional (Satversme) meeting chairman within 7 days.

  4. Constitutional (Satversme) meeting:

    1. adopts Daugavpils University Constitution (Satversme);

    2. adopts the regulations of Daugavpils University Constitutional (Satversme) meeting;

    3. makes amendments in Daugavpils University Constitution (Satversme) and regulations of Constitutional (Satversme) meeting;

    4. elects Daugavpils University Senate, adopts and makes amendments in Senate regulations, recalls the members of the Senate;

    5. elects and dismisses the rector;

    6. hears and listens to the rector’s account report;

    7. confirms the regulations of the Inspection commission and the Arbitration court;

    8. elects Inspection commission;

    9. elects Arbitration court;

Constitutional (Satversme) meeting has the right to accept for the examination and adoption of a decision also other conceptual questions of Daugavpils University activity and development.

  1. Constitutional (Satversme) meeting is called by the rector or the Senate but not less than once in three years. Extraordinary Constitutional (Satversme) meeting shall be called earlier of it is demanded by the Senate, the rector or by not less than one third of the number of Constitutional (Satversme) meeting delegates.

  2. The work of Constitutional (Satversme) meeting is determined by Daugavpils University Constitutional (Satversme) meeting regulations. The decision of the Constitutional (Satversme) meeting can be appealed in Arbitration court within 10 days. The decision of the Constitutional (Satversme) meeting is suspended till the adoption of the Arbitration court decision and its confirmation at the Senate.

  3. The Constitutional (Satversme) meeting elects the chairman, his/her deputy and a secretary by open voting.

  4. The Senate is Daugavpils University staff collegiate administration and decision making institution which confirms the agenda and rules regulating all the spheres of activity of the higher school.

  5. The Constitutional (Satversme) meeting elects the Senate for three years: 17 representatives from Daugavpils University academic staff, including 6-8 representatives from the deans, heads of the chairs, departments, scientific institutions; not less than a half shall be professors and associated professors; 4 representatives to the Senate are elected from the students and 4 from the administrative staff on rector’s proposal. The representatives of the academic staff are nominated to the Senate by the meetings of the representatives of academic staff. The students’ representatives are nominated to the Senate by students’ self-government.

  6. In accordance with Daugavpils University major directions of activity, the Senate may form permanent commissions which work out proposals or give their conclusions about the projects of the decisions according to their competence. The order of the work of the commissions is regulated by the rules confirmed by the Senate.

  7. The meetings of the Senate are conducted by the Senate chairman or his/her deputy. The work of the Senate is regulated by the rules confirmed by the Constitutional (Satversme) meeting.

  8. The decisions adopted at the Senate may be appealed at Daugavpils University Arbitration court within one week after the Senate meeting. The application with a motivated claim for canceling the decision shall be submitted. At the next Senate meeting the Arbitration court informs about the results of examining the application. If the Arbitration court recognizes it as well-substantiated, the question is examined at the Senate again, if it is recognized as unsubstantiated, the decision of the Senate remains in force.

  9. The work of the Senate is organized and ensured by the management of the Senate: the chairman, deputy of the chairman and a secretary. The rector may suspend the decision of the Senate immediately after its adoption, if the decision contradicts to the laws and other normative acts or to Daugavpils University Constitution (Satversme).

  10. Daugavpils University Senate:

    1. elects and recalls the chairman and the deputy chairman of the Senate;

    2. elects:

      1. pro-rectors;

      2. Convent of Advisers;

      3. The Senate budget commission;

    3. approves:

      1. the secretary of the Senate on the Senate chairman’s proposal;

      2. executive director and director on the rector’s proposal;

      3. after election to the post: deans, directors of institutes, heads of departments, docents, and leading researchers;

      4. study programmes;

      5. additional regulations of enrolment;

      6. regulations of Daugavpils University structural units, commissions and councils;

      7. the statutes of the societies and enterprises founded at Daugavpils University;

      8. rules of election to academic and administrative posts;

      9. rules of students’ self-government;

      10. documents regulating conceptual study process and scientific activity;

      11. Daugavpils University budget;

      12. regulations of the Convent of Advisers;

      13. rules of inner work routine;

    4. decides about questions which are significant for the University academic and scientific activity.

  11. Daugavpils University has the Convent of Advisers. It promotes coordination of the University work with the public interests, consults the Senate and the rector in questions of Daugavpils University development strategy. The Convent of Advisers is elected and its rules are approved by the Senate.

  12. The rector is elected by the Constitutional (Satversme) meeting from professors for 5 years, but no more than two times in turn. The rector is approved by the Cabinet of Ministers of the Republic of Latvia. The rector is Daugavpils University highest official person implementing Daugavpils University administrative management and represents Daugavpils University without a special authorization. Within the framework of his/her competence the rector issues orders. The decision adopted by the rector may be appealed at the Constitutional (Satversme) meeting within 10 days. The rector’s decision is suspended till the adoption of the decision at the Constitutional (Satversme) meeting. The rector is dismissed from his/her post by the Cabinet of Ministers on the initiative of Daugavpils University Constitutional (Satversme) meeting or the Ministry of Education and Science if there are violations of the law or other normative acts in the rector’s activity. The rector:

    1. manages and conducts Daugavpils University activity and is responsible for it, implementing the requirements of this Constitution (Satversme) and the decisions of the Senate;

    2. is responsible for the correspondence of Daugavpils University activity to the law of Higher Schools and other normative acts, as well as to Daugavpils University Constitution (Satversme);

    3. is responsible for the quality of education obtained at Daugavpils University, quality of the carried out scientific research and realized artistic creative work;

    4. ensures legal, economical and purposeful use of Daugavpils University budget means and Daugavpils University property; is personally responsible for the financial activity of the higher school;

    5. promotes Daugavpils University staff and students academic freedom.

  13. Inspection commission is elected from the University staff by Daugavpils University Constitutional (Satversme) meeting; commission is elected five persons in number for three years. The representatives of the administrative staff cannot be members of the inspection commission. Inspection commission has the right to inspect the correspondence of all Daugavpils University activity spheres to the existing legal normative acts, Daugavpils University Constitution (Satversme) and decisions of management institutions, to demand and receive explanations from officials, as well as to get acquainted with all the documents relating to Daugavpils University financial and economic activity. Inspection commission audits not less than once a year, the commission reports about the results of inspection to the Senate. The members of Inspection commission are recalled by Daugavpils University Constitutional (Satversme) meeting on the initiative of the Senate. The decision of Inspection commission may be appealed at Daugavpils University Senate within 10 days. The decision of Inspection commission is suspended till the adoption of the decision at the Senate. The regulations are approved by the Constitutional (Satverme) meeting.

  14. The Arbitration court, five persons in number, is elected from academic staff by Daugavpils University Constitutional (Satversme) meeting in closed voting for three years. Representatives of administrative staff cannot be members of Arbitration court. Arbitration court examines arguments between University officials, management institutions of structural units that work in subordinate position, as well as students’ and academic staff applications about restriction and violations of academic freedoms and rights determined by the Constitution (Satversme). The members of Arbitration court are responsible for their work to Constitutional (Satversme) meeting, and on the initiative of the employer they can be dismissed from work only with the agreement of Constitutional (Satversme) meeting. The members of Arbitration court are recalled by Daugavpils University Constitution (Satversme) meeting on the initiative of Daugavpils University Senate. The decisions adopted by Arbitration court, approved by the Senate, are fulfilled by the administration. The decision adopted by Arbitration court may be appealed to the Senate within 10 days. The decision of Arbitration court is suspended till the adoption of the decision of the Senate. The regulations of Arbitration court are approved by Constitutional (Satversme) meeting.

  15. The number of pro-rectors is determined by the rector. Pro-rectors are elected by the Senate in accordance with the regulations about administrative posts. Their responsibilities are determined by corresponding rules.

  16. Executive director and director are confirmed in his/her post by the Senate on the rector’s proposal. Their responsibilities are determined by corresponding rules.

  17. The Study Board coordinates the realization of the study programmes at Daugavpils University; it acts as the institution representing study programmes. The Study Board has Pro-rector responsible for studies, deans, and the Head of the Study Department. Its composition is confirmed by Daugavpils University Senate for three years. The members of the Study Board are recalled by Daugavpils University Senate. The main responsibilities of the Study Board are the coordination of development and implementation of study plans and programmes for obtaining bachelor and master degrees, working out the study scheme, its analysis, updating and determining the main directions of development. The Study Board has the right to confirm the study schedules, study programmes and plans, enrolment rules. The regulations of the Study Board are approved by Daugavpils University Senate.

  18. The Science Council coordinates the research work at Daugavpils University as the representative institution of science branches and sub-branches. The Science Council has the Pro-rector responsible for science work as well as representatives of academic staff nominated by the faculties and departments; its composition is confirmed by Daugavpils University Senate for three years. The members of the Science Council are recalled by Daugavpils University Senate. The main responsibilities of the Science Council are determination of the priority directions of scientific work, planning and coordination of the scientific work of academic staff and students, promoting international scientific cooperation, evaluation and summing up of the research results. The Science Council has the rights to examine and decide the questions about financing scientific research, to confirm candidates of the expert councils conferring scientific degrees and their regulations. The regulations of the Science Council are confirmed by Daugavpils University Senate.

  19. The Economy Board manages Daugavpils University economic activity. The Economy Board includes the director, managers of buildings, representative nominated by the Students’ Council, representative nominated by Trade Union committee. Its composition is approved by Daugavpils University Senate for three years. The members of the Economy Board are recalled by Daugavpils University Senate. The main responsibility of the Economy Board is to coordinate the questions of the provision of the study and scientific research work, as well as the material technical provision for the students’ living conditions at the students’ hostels. The Economy Board has the rights to sum up and analyze the information about Daugavpils University material base, to confirm the plan of priority economic activities, to prepare the calculations of financial means necessary for the solution of economic questions in order to discuss them at Daugavpils University Senate. The regulations of the Economy Board are confirmed by Daugavpils University Senate.




  1. STRUCTURAL UNITS OF DAUGAVPILS UNIVERSITY




  1. Daugavpils University educational and scientific work structural units may be: faculties (departments), institutes, chairs, groups of professors, scientific laboratories. Daugavpils University has the right to form also other structural units for carrying out organizational, economic and service work.

  2. Daugavpils University structural units have no status of legal (juridical) person.

  3. Daugavpils University structural units are formed, reorganized or liquidated by the Senate, their activity is regulated by the rules approved at the Senate.

  4. Faculty is the structural unit which unites and organizes the studies and scientific work of one scientific, artistic, or professional direction or of several directions. The work of the faculty is determined by the regulations confirmed at the Senate.

    1. The dean manages and conducts the activity of the faculty. The faculty staff elects Council. From academic staff the council elects the chairman, secretary, dean, heads of the chairs, docents, leading researchers, lecturers, researchers and assistants. The Council decides the questions of studies, faculty economic, financial and other activities or decides about their examination at the Senate. The Council has the right to initiate the dismissal of the faculty staff from their post. The clerical work of the faculty is managed by the faculty management secretary (-ies).

    2. The Dean is elected by the faculty Council in an open competition for 5 years but not more than two times in turn. The order of the election is envisaged by the regulations. The Dean is the official representative of the faculty. He/she is responsible for the preparation of the council meetings, implementation of the decisions; he/she is responsible for the organization of the study and scientific work, the faculty economic and financial activity.

  5. The Chair (Department) is the study and research work structural unit that develops and realizes the study programmes and carries out scientific research in some of science sub-branches. The Chairs are formed, reorganized and liquidated by the decision of the Senate on the proposal of the faculty council or pro-rector responsible for study work. Its work is determined and conducted by the meeting of the chair (department) academic staff. The meeting of the academic staff nominates the head of the chair from professors, associated professors and docents. They are elected by the faculty council at the open competition for six years. The head of the chair (department) is the official representative of the chair in all its matters. The chairs may form their own structural units. The regulations of the chairs are approved by the Senate.

  6. Group of professors may be formed by a professor or associated professor if financing in his/her conducted study programmes and scientific themes allows hiring not less than three academic or scientific employees. The group of professors and its regulations are approved by the Senate on professor’s or associated professor’s proposal.

  7. Scientific laboratory realizes the research work programmes, carries out research in some of science sub-branches and participates in the implementation of the study programmes. The laboratory is formed, reorganized or liquidated on the proposal of the faculty or institute council. Its regulations are approved by the Senate.

  8. The Institute is the study and scientific work structural unit uniting related chairs (departments) or scientific research laboratories. It participates in the implementation of the study programmes of corresponding faculties, determines and realizes research programmes. The decision about the founding of the institute is adopted by the Senate on the initiative of the faculty council, if its composition corresponds to the requirements of forming board of experts conferring scientific degrees in corresponding branch of science. The Institutes are formed at the faculties or as an independent Daugavpils University structural unit. The work of an independent institute is conducted and managed by the council and director. The Institute council is formed by all its professors and associated professors, as well as elected representatives of other academic staff. The director of the institute is elected from professors, associated professors or leading researchers, docents for five years, but not more than two times in turn. The Institute activity is determined by the regulations approved at the Senate.

  9. Daugavpils University structural units have the right to open sub-accounts (at the bank).




  1. STAFF




  1. Daugavpils University staff is formed by:

    1. academic staff for whom Daugavpils University is the basic work place;

    2. general staff for whom Daugavpils University is the basic work place;

    3. full time students, also Master course students, Doctoral students and residents;

  2. General Daugavpils University staff is administrative staff, study assistance staff, technical staff, economy and other staff, excluding academic staff. Daugavpils University administrative staff is the rector, pro-rector, director, executive director, dean and other officials whose basic function is administrative work.

  3. For the realization of the study programmes and research projects and carrying out other duties the University may hire also employees for whom Daugavpils University is not the basic place of work. Their responsibilities are the same as the responsibilities of Daugavpils University staff.

  4. The rights and duty of Daugavpils University staff are to promote the study and research work freedom, to enhance transparency in Daugavpils University management and handling of its matters. The staff has to fulfill its duties so that Daugavpils University could implement its tasks, not to violate rights of any other person and not to disturb the fulfillment of post or work duties. In the order determined in accordance with this Constitution (Satversme) the staff has the right to participate in working out the decisions of Daugavpils University administration and self-government and in working out the rules of inner work routine of Daugavpils University, to participate and speak at Daugavpils University collegiate management institution meetings and adoption of decisions on questions concerning the staff’s interests. The staff has the right to participate in Daugavpils University self-government institutions elections and to be elected there.

  5. To take care about the staff’s working conditions, as well as to provide the possibility for its professional development and requalification is the duty of Daugavpils University administration.

  6. The staff is responsible for the fulfillment of its duties. The Senate determines the order how to evaluate the violations and how to apply sanctions for not fulfilling one’s duties taking into consideration the existing legal normative acts.

  7. Daugavpils University academic staff is formed by:

    1. professors, associated professors;

    2. docents, leading researchers;

    3. lecturers, researchers,

    4. assistants.

The academic staff carries out scientific research and participates in the education of the students. The amount of the tasks is determined by the corresponding structural unit.

  1. Daugavpils University elected positions of professor, associated professor, docent and administrative posts (rector, pro-rector, dean) may be held till the age of 65. The rector may conclude individual agreements with retired academic staff.

  2. Professors and associated professors may be awarded honorary title – emeritus professor - for special contribution in higher education when they reach retirement age.

  3. Professor is an internationally recognized specialist in his branch carrying out scientific research or artistic creative work corresponding to modern level and ensures high quality studies in corresponding science or art sub-branch. A person with doctor’s degree and not less than two years work experience may be elected as Daugavpils University professor or associated professor. Persons whose artistic creative work results correspond to Daugavpils University regulations about academic posts may be elected to the position of arts speciality professor. Professor is elected by the corresponding science branch professors’ board in an open competition for six years, the rector concludes with him/her work agreement for the whole elected period or for the time till the age of 65. The Minister of Education and Science determines the number of professors’ positions at Daugavpils University.

The main tasks of professors are:

    1. delivering highly qualified lectures, supervision of the studies, classes and examinations in his/her study course;

    2. conducting the research work in science sub-branch or conducting artistic creative work in the branch corresponding to the title of professor’s position;

    3. conducting doctoral level study and research work in science sub-branch or conducting artistic creative work in the branch corresponding to the title of professors’ position;

    4. participation in the evaluation of the study programmes, Daugavpils University and its structural units work and quality;

    5. preparation (training) of new generation of scientists, artists and teaching staff.

  1. A person with doctor’s degree may be elected as Daugavpils University associated professor. Persons, the results of whose artistic creative work or professional activity correspond to Daugavpils University regulations about academic positions, may be elected as art specialities associated professors. Associated professor is elected by the corresponding branch professors’ board in an open competition for six years and the rector concludes with him/her work agreement for the whole elected period or for time till the age of 65. Daugavpils University Senate determines the number of associated professor positions on the proposal of the rector or the Study Board.

The main tasks of the associated professor are:

    1. research work in science subbranch or artistic creative work branch corresponding to the title of the associated professor position;

    2. conducting research work for obtaining doctor’s and master’s degree;

    3. conducting educational work, especially higher level studies’ classes and examinations in corresponding course, delivering lectures;

    4. education and support of young generation of scientists, artists and teaching staff.

  1. A person with doctor’s degree may be elected as Daugavpils University docent. Persons, the results of whose artistic creative work correspond to Daugavpils University regulations about academic positions, may be elected as art specialities docents. Docents are elected by the faculty or institute council for six years and the rector concludes with him/her work agreement for the whole elected period or till the age of 65.

The main tasks of docents are:

    1. research work in science sub-branch or artistic creative work corresponding to the title of docent’s position;

    2. delivering lectures, conducting classes, organizing examinations and tests in his/her study programme (course, branch), especially its major courses.

  1. A person with doctor’s degree may be elected as leading researcher in an open competition for six years. The leading researcher is elected by the faculty or institute council. The rector concludes with him/her work agreement for carrying out concrete scientific project (grant, agreement work).

The main tasks of leading researchers are:

    1. to carry out independently scientific research in corresponding science sub-branches;

    2. to conduct research work of other scientists.

  1. Persons with doctor’s or master’s degree may be elected as lecturers. The lecturer is elected by the faculty or institute council for six years, and the rector concludes with him/her work agreement for the whole elected period of time.

The main tasks of the lecturer are:

    1. research work in the corresponding science sub-branch;

    2. delivering lectures, conducting seminars, practical classes and laboratory works, organization of examinations in his/her study programme.

  1. Persons with doctor’s degree may be elected as researchers in an open competition for six years. The researcher is elected by the faculty or institute council. The rector concludes with him/her work agreement for carrying out a concrete scientific project (grant, agreement work). Researchers’ main task is to carry out qualitative research in respective science sub-branch.

  2. Persons with doctor’s or master’s degree may be elected as assistants. Assistants are elected by the faculty or institute council for six years and not more than two times in turn if the candidate has no doctor’s degree. The rector concludes with him/her work agreement for the whole elected period of time.

The main tasks of the assistant are:

    1. research work in respective science sub-branch;

    2. conducting seminars, practical work and laboratory work;

    3. conducting practice, course papers and projects;

    4. checking tests and independent work;

    5. organization of examinations.

  1. Taking into account the necessity to acquire practical skills and knowledge, in professional study subjects academic staff may be elected without a scientific degree:

    1. as an associated professor with corresponding higher education and at least 10 years of practical work experience in corresponding branch;

    2. as a docent with corresponding higher education, but with at least 7 years of practical work experience in corresponding branch;

    3. as a lecturer and assistant with higher education, but at least 5 years practical work experience corresponding to the subjects taught.

The requirements for these candidates are set in the regulations about academic positions.

  1. If Daugavpils University has a free or temporarily free position, the Senate on the proposal of the faculty council may decide not to announce a competition, but hire for work a guest-professor, guest-docent or guest-lecturer (each one time) for the time period till two years. Their rights, duties and salaries are the same as professors’ docents’ and lecturers’, but they cannot participate in the work of elected administration institutions.

  2. Academic staff shall have eight weeks paid leave every year, but after every six years – paid academic leave for scientific research or carrying scientific work outside one’s work place lasting six calendar months. One time academic staff has the right also to get three months study leave for the preparation of doctor’s dissertation.

  3. The Senate determines the principles of payment to academic staff. The rate of payment for work cannot be less than envisaged by the Cabinet of Ministers.




  1. STUDENTS, STUDY FEES AND CREDITS




  1. Students of Daugavpils University are:

    1. students of bachelor and master study programmes;

    2. students of professional study programmes;

    3. doctoral students.

  2. Students of Daugavpils University have the right:

    1. to obtain higher academic education;

    2. to obtain higher professional education;

    3. to obtain doctor’s scientific degree;

    4. to receive information connected with the study process;

    5. to acquire the individual study part of free choice;

    6. to carry out research and artistic creative work;

    7. in envisaged order to use Daugavpils University premises, libraries, equipment and apparatuses, cultural, sports and medical facilities;

    8. in envisaged order suspend and resume the studies;

    9. in envisaged order as listeners to attend events at other higher schools (also abroad) and take the required tests and examinations;

    10. to elect and be elected into students self-government, to participate at all levels of Daugavpils University self-government institutions;

    11. to express freely and defend one’s own thoughts and opinions;

    12. to found societies, circles and clubs.

  3. At Daugavpils University the study of foreigners takes place in accordance with the law of Higher Schools.

  4. At Daugavpils University the study fee is fully or partially covered by the state, as well as juridical or physical persons in accordance with the agreements which Daugavpils University concluded with the students. The state determines the number of student places at Daugavpils University which are financed from the state budget.

  5. Those who study in accredited programmes may apply for the studies or students’ credits. The order of allotting a credit and its repayment order is determined by the Cabinet of Ministers.




  1. SCIENTIFIC RESEARCH




  1. Scientific research is an integral part of Daugavpils University work, all academic staff participates in it. Its aim is obtaining scientific facts, regularities and conclusions, scientific substantiation and further development of learning, teaching and studies, solution of practical important tasks with research methods.

  2. According to the means allotted for scientific research work the supervisors of scientific work independently determine the themes and amount of their research, Science Council coordinates joint plans of research at Daugavpils University and decides the issues of financing the themes.

  3. Daugavpils University not less than once a year publishes summarizing materials about the research carried out and sends them to other higher schools, as well as to Latvian Science Council, Ministry of Education and Science and other interested state institutions.

  4. Daugavpils University has promotion boards of experts which confer doctor’s degree in corresponding scientific branches. Science Council confirms the regulations of the work of these Boards. The order of conferring doctor’s degree is determined by the regulations about the order and criteria of the work of these Promotion Boards of experts.




  1. STUDENTS’ SELF-GOVERNMENT




  1. Daugavpils University students have their own self-government working in accordance with the regulations approved by the Senate. Self-government may have the right of juridical person if it is registered as public organization or as a non-profit organization.

Daugavpils University students’ self-government:

    1. defends and represents students interests on issues of academic, material and cultural life at Daugavpils University and other state institutions;

    2. represents Daugavpils University students in Latvia and abroad;

    3. determines the order of electing students to Daugavpils University collegiate institutions.

77. The task of Daugavpils University administrative institutions is to support and promote students’ self-government activity.

78. Daugavpils University students’ self-government has the right to demand and receive information and explanations from any Daugavpils University structural unit in all questions concerning students’ interests.

79. At the Constitutional (Satversme) meeting, Senate, council the students have the right of suspending veto in questions concerning students’ interests. The representatives of the students’ self-government have the right to participate in the work of Daugavpils University decision making institutions, as well as the rights to participate as observers at tests and examinations.


  1. PRPERTY, BUDGET AND ECONOMIC ACTIVITY

80. Daugavpils University may have:

80.1. movable property;

80.2. immovable property;

80.3. intellectual property;

80.4. money means in Latvia and abroad;

81. Daugavpils University property consists of:

81.1. sequestered state property part passed over to Daugavpils University by the decision of the Cabinet of Ministers;

81.2. land, movable and immovable property donated by physical and juridical persons or which Daugavpils University purchased for its own earned or state allotted budget means;

81.3. Daugavpils University intellectual property in accordance with the Copyright law.

82. Daugavpils University has the right to handle its property for the attainment of the aims indicated in the Constitution (Satversme).

83. The order of management of the state property, passed over for the management or use by Daugavpils University, is determined according to the rules approved by the Minister of Education and Science and the use of this property is controlled by respective state institutions according to the mentioned rules.

84. Daugavpils University Senate determines the formation, structure and the use of Daugavpils University budget.

85. Daugavpils University budget consists of:

85.1. subsidies from the state budget for education envisaged for Daugavpils University major activity;

85.2. subsidies from the state budget which Latvian Science Council allots to Daugavpils University for financing science, coordinating it with Ministry of education and Science;

85.3. payment services, payment studies and other University incomes.

86. Daugavpils University has the right:

86.1. to conclude agreements with physical and juridical persons, as well as to carry out other juridical actions in accordance with the law of Higher Schools and other normative acts.

86.2. to announce bidding, to buy and sell movable and immovable property, various property and securities in accordance with the normative acts and corresponding to Daugavpils University activity objectives.

86.3. to carry out entrepreneurship activity corresponding to Daugavpils University objectives and tasks (the incomes shall be transferred to the University budget for its development), as well as to invest the obtained means into other enterprises corresponding to the aims of Daugavpils University.

87. Daugavpils University is freed from customs tax and duties, as well as from taxes for the import of reconstruction materials and equipment. As a tax-payer Daugavpils University is considered as a non-profit organization and it has the right to receive tax alleviations in accordance with normative acts.

88. Independent auditor audits Daugavpils University financial and economic activity, also the reports of the Inspection Commission are checked by an independent auditor not less than one time in two years. The statement prepared by the auditor about Daugavpils University financial and economic activity is handed in to the Ministry of Education and Science.


  1. THE ORDER OF ADOPTING THE CONSTITUTION (SATVERSME) AND ITS AMENDMENT

89. Daugavpils University Constitution (Satversme) can be adopted and amended only by Daugavpils University Constitutional (Satversme) meeting authorized by Daugavpils University staff and elected in the envisaged order.

90. The amendments of Constitution (Satversme) may be forwarded by Daugavpils University Constitutional (Satversme) meeting.

91. The order of electing Constitutional (Satversme) meeting and it regulations are determined by Daugavpils University Constitutional (Satversme) meeting rules. The amendments in Constitutional (Satversme) meeting rules may be done by Constitutional (Satversme) meeting.

92. Daugavpils University Constitution (Satversme) and amendments in it come into legal force when they are approved by the Parliament (Saeima) of the Republic of Latvia.
