Defending an Ordinary Action
If an action is raised against you in the Court of Session, you will
be served a
copy of the summons. The summons will detail the case against you. If you
wish to defend the action, you must lodge defences. There is a fee for lodging
defences, please refer to the fee guidance on the SCTS website for the current
lodging fee.
The summons includes statements of the pursuer’s claim against you. Your
defences
should answer each statement, in numbered paragraphs. They
should be headed up as “
Defences
”, and include the instance as per the
summons. The instance is the name and addresses of the pursuer(s) and
defender(s).
