INTRODUCTION
The Parties to the Basel Convention are required, in accordance with Articles 13 and 16 of the Convention, to inform each other, through the Secretariat of the Basel Convention, on issues related to the implementation of the Basel Convention. To facilitate reporting by Parties, the secretariat has revised the questionnaire on “Transmission of Information”. The revised questionnaire consists of two parts, namely, Part I: Status of information; and Part II: Annual reporting.
Part I: Status of information: to further facilitate reporting, Part I of the questionnaire is pre-filled by the secretariat (provided that Parties have reported for the year 1999 and/or onwards, in the required format).
Part I essentially covers those issues for which information provided by Parties usually remains the same as that reported during the previous year(s). While updating the pre-filled questionnaire, if there is any change in the information provided (including necessary corrections or deletions) during the previous reporting period, it needs to be indicated by Parties in the right hand column of the questionnaire by ticking the box stating “yes” and accordingly, the corresponding information should also be updated. Using “track changes” function of the ‘Word’ program is recommended to update the information. If there is no change in the information, it is sufficient to indicate it in the right hand column of the questionnaire by ticking the box stating “no”.
Part I: covers issues such as designation of Competent Authority and Focal Point; national definitions of waste; national definitions of hazardous waste; restrictions on transboundary movements of hazardous wastes and other wastes; control procedure of the transboundary movements of waste; reduction and/or elimination of the generation of hazardous wastes and other wastes; reduction of the amount of hazardous wastes and other wastes subject to transboundary movements; effect on human health and the environment; bilateral, multilateral or regional agreements or arrangements; disposal and recovery facilities and sources of technical and financial assistance.
Part II: Annual reporting covers those issues for which reporting is required on an annual basis. For the ease of electronic reporting and processing of the reported data/information, Part II: Annual reporting is divided into two sections namely, Section A and Section B.
Part II: Section A covers issues such as export/import hazardous wastes and other wastes and generation of hazardous wastes and other wastes.
Part II: Section B covers issues such as disposals, which did not proceed as intended and accidents occurring during the transboundary movement and disposal of hazardous wastes and other wastes.
Some of the general guidelines to fill in the questionnaire are:

Complete the questionnaire in English.

Ensure that all quantities are in metric tons.

Complete the questionnaire by providing information/data in the required format.

Provide an electronic version of the completed questionnaire, if possible, or use a typewriter or else handwritten in block letters for legibility.
The manual could be referred for more information, which is available in all six United Nations languages (Arabic, Chinese, English, French, Russian and Spanish).
The questionnaire and the manual are available both in hard copy as well as in electronic version from the secretariat (Part I and Part II: Section B of the questionnaire are in Word; and Part II: Section A of the questionnaire is in Excel. The manual is in Word).

Directive 2006/12/EC , art.1: “waste” shall mean any substance or object in the categories set out in Annex I which the holder discards or intends or is required to discard.
The national legislation : article L 541-1 – II du code de l'environnement gives the following definition : “Déchet » : « tout résidu d’un processus de production, de transformation d’un déchet, qui n’est plus susceptible d’être traité dans les conditions techniques et économiques du moment, notamment par extraction de la part valorisable ou par réduction de son caractère polluant ou dangereux. »

In the case of shipments of waste included in art 1(1)b, the EU regulation 1013/2006 and the EU regulation 1418/2007 requires the prior written consent or or requires such shipments to be accompanied by certain information (“information procedure”), depending on the country of destination and the purpose of the shipment. The exportation of such waste under art. 1(1)b can also be banned.
For those waste which are not included in art 1(1)a or 1(1)b, even if they've got an identification waste code in the EU legislation (Decision 2000/532/EC establishing a List of Wastes as last amended by Decision 2001/573/EC) , the EU regulation 1013/2006 requires the prior written consent.

In accordance with regulation 1013/2006, art 41, countries parties to the BC which want to sent waste for final disposal to France are required to present a prior duly request to the french CA of destination on the basis that they do not have and cannot reasonably acquire the technical capacity and the necessary facilities in order to dispose of the waste in an environmentally sound manner.

Transposition in French law ongoing
WEEE collection and recycling
WEEE directive 2002/96/EC: implemented in France by a ministerial decree of 20th July 2005.
Producers are responsible for collecting and treating WEEE from households and professionals:
-
Household WEEE: producers are members of collective schemes, financed by "visible fees" paid by consumers. These schemes collect WEEE deposited by consumers at civic amenity sites or distributors, and bring them to recycling facilities.
-
Professional WEEE: producers build individual systems, financed by themselves, which collect WEEE from their customers.
Classified installations fort he protection of environnement regulation (code de l'environnement)
Nomenclature imposing a permit or declaration system depending on the significance of the risks or inconvenience which may be caused.
The classified installations for the protection of the environment regulation is a way of applying the waste prevention principle.

The impact assessment of the application for a license allowing to operate an classified installation for the protection of the environment has to evaluate :

volume of waste that would be produced by the facility, and its polluting potential;

measures that would remove, reduce and compensate the disadvantages associated with the operation, particularly in terms of waste disposal operations.

Decree N°. 98-638 from July 20th 1998 about how to take into account the environment requirements in the design and the manufacturing of packaging ; Decree N° 99-374 from May 12th 1999 about introducing batteries in the market and their disposal ; Decree N° 2002-1563 from December 24th 2002 about the disposal of used tyres ; Decree N° 2003-727 from August 1st 2003 about the treatment of end-of-life vehicles ; and Decree N° 2005-829 from July 2005 relating the composition of electrical and electronic equipment and to the disposal of waste from this equipment.
Transboundary movements of waste :
Different measures are on preparation in order to implement the EC Regulation 1013/2006. Their adoption by the French Parliament is expected in 2009.
Waste prevention (waste stream such as D3E.cf previous questionnaries..)
A draft decree is on preparation in order to implement the directive 2006/66/CE and the directive 2008/103/CE concerning the placing on the market of batteries and accumulators and the disposal of waste batteries and accumulators. Its adoption is expecting in 2009.

According to the directive 2008/98/EC and the regulation 1013/2006 on transfrontier waste shipment, in the case of shipment of waste for disposal, the principles of proximity, priority for recovery and self-suffiency at Community and national levels should be taken into account. Based on those principles, in France, Competent authorities can object to shipment, in a case by case basis, taking in account local waste management plans (every region must have a waste management plan for hazardous wastes; and every department must have a waste management plan for household waste) and the principles of proximity, priority for recovery and self-suffiency.
