Part Time Employees
S1.6.1 Payment of salary for any period of duty or leave with pay will be subject to the decimal multiplier determined pursuant to clause 4.3.3.4.
SCHEDULE 2 - CLASSIFICATION STRUCTURE

S2.1 Definitions:
S2.1.1 Three year qualification means a Diploma in Teaching or Bachelor of Teaching Degree or another qualification recognised as equivalent by the Teachers Registration Board of South Australia. The qualification must have been awarded upon successful completion of a prescribed academic course of three years duration.
S2.1.1.1 An employee who holds a qualification of less than 3 years training but has satisfied the statutory requirements to practise as a teacher in South Australia will be deemed to hold a 3 year trained qualification.
S2.1.2 Four year qualification means a Bachelor of Education Degree or other Degree which together with a post Graduate Diploma is recognised as equivalent by the Teachers Registration Board of South Australia. The qualification must have been awarded upon the successful completion of a prescribed academic course(s) of 4 years total duration.
S2.1.3 Five year qualification means a 4 year Degree together with a post Graduate Diploma; or an Honours Degree or other Higher Degree which together with a post Graduate Diploma is recognised as equivalent by the Teachers Registration Board of South Australia. The qualification must have been awarded upon the successful completion of a prescribed academic course(s) of 5 years total duration.
S2.2 Band 1 Teacher
S2.2.1 Band 1 employees will be professionally responsible, either as a class or subject teacher, for the application of pedagogic and curriculum knowledge and skills for the educational benefit and pastoral care of students in their charge.
S2.2.2 The commencing salary of a band 1 employee without experience but who upon appointment holds a 3 year qualification will be not less than the salary prescribed at incremental step 1 of the salary scale for band 1 employees detailed in Schedule 1.
S2.2.3 The commencing salary of a band 1 employee without experience but who upon appointment holds a 4 year qualification will be not less than the salary prescribed at incremental step 3 of the salary scale for band 1 employees detailed in Schedule 1.
S2.2.4 The commencing salary of a band 1 employee without experience but who upon appointment holds a 5 year qualification will be not less than the salary prescribed at incremental step 4 of the salary scale for band 1 employees detailed in Schedule 1.
S2.2.5 The commencing salary of a band 1 employee with experience will be at an incremental step which recognises at least all prior teaching experience calculated in full time equivalent years and satisfactory evidence of which is provided to the employer.
S2.3 Incremental Advance in Salary
S2.3.1 An employee will be entitled following the appointment at a particular incremental step in the salary scale in Schedule 1 to progress to the next higher incremental step of the scale after 12 calendar months of full time service. Part-time band 1 employees will be entitled to progress to the next higher incremental step of the scale after 12 months equivalent full time teaching experience wherever gained.
S2.3.2 An employee who, subsequent to appointment, gains a 4 year qualification will be entitled to progress one additional incremental step in the salary scale on 1 February following the completion of the requirements for the qualification.
S2.3.2.1 Where the requirements are completed at a time other than between 1 September and 31

December, the additional increment will be paid from the first pay period following the completion of the requirements for the qualification.


S2.3.2.2 Academic qualifications will be deemed to be completed if the employee obtains from the tertiary institution a statement to that effect.
S2.3.3 Employees who hold a 3 year qualification will advance by annual increment to step 8 in the scale and subsequently to steps 9 and 10 by biennial increment.
S2.3.4 Employees will be entitled to progress to increment step 10 and be eligible to apply for Advanced Skill Teacher status on meeting the statutory requirements set out in Schedule 3.
S2.4 Advanced Skill Teacher
S2.4.1 Advanced Skill Teachers are employees classified as such in recognition of exemplary teaching practice and significant contribution to the educational tone of the school.
S2.4.2 Advanced Skill Teachers are employees who have satisfied and continue to satisfy the requirements of Schedule 3.
S2.4.3 Advanced Skill Teachers will have an acknowledged profile in the school and will have responsibilities normally expected of a Band 1 Teacher.
S2.4.4 Advanced Skill Teachers will be a sub-classification of Band 1 Teachers.
S2.4.5 Review of Advanced Skill Teacher classification
S2.4.5.1 Employees who achieve Advanced Skill Teacher classification will continue to be so classified subject to their satisfying the Principal at intervals of no less than 2 years but no more than 5 years that they continue to fulfil the relevant prescribed classification criteria.
S2.4.5.2 Where the Principal is not satisfied that an Advanced Skill Teacher continues to fulfil all relevant prescribed classification criteria the Principal will require the employee to undergo an appraisal by a panel constituted as described at clause S3.3.4 of Schedule 3.
S2.4.5.3 An appraisal panel convened according to this sub-clause will give due consideration to a Principals written submission, but otherwise will proceed in a manner consistent with clauses S3.2 and S3.3 of Schedule 3.
S2.4.5.4 An Advanced Skill Teacher whose classification is not confirmed by the appraisal panel will revert to a Band 1 step 10 salary but will be eligible to make further application for Advanced Skill Teacher classification after one year has elapsed.
S2.4.6 Portability
S2.4.6.1 Where an Advanced Skill Teacher seeks and gains an appointment by a second respondent school the employee will be eligible to retain the classification.
S2.4.6.2 The Principal of the second school may require the employee to undergo an appraisal as prescribed in Schedule 3 on or about the first anniversary of appointment.
S2.4.7 Salary
S2.4.7.1 Advanced Skill Teachers must be paid the substantive salary outlined in Schedule 1 clause S1.1.
S2.5 Band 2 Teachers
S2.5.1 Band 2 teachers will be appointed at level 1, 2, 3 or 4 by the Principal of the employing school to carry out specific duties or responsibilities as determined between the employee and the Principal. These appointments are Leadership Positions as detailed below in clause S2.6.
S2.5.2 Band 2 Level 1 and Band 2 Level 2 teachers will be paid the allowance in Schedule 1 clause S1.2 in addition to their substantive band 1 salary (including Advanced Skill Teacher salary if the employee is so classified).
S2.5.3 Band 2 Level 3 and Band 2 Level 4 teachers will be paid the allowance in Schedule 1 clause S1.2 in addition to their substantive Band 1 salary but although these employees are entitled to apply for the classification of Advanced Skill Teacher, they are not eligible to receive the salary pertaining to that classification recognising that Leadership duties at these levels customarily have diminished classroom teaching duties.
S2.6 Leadership Positions
S2.6.1 Leadership position means any position filled for the time being by any teacher classified as Band 2.
S2.6.2 Prescribed Leadership Points
S2.6.2.1 Each secondary school will appoint employees to leadership positions in such numbers as to at least utilise prescribed leadership position points determined for that school. The leadership points will be calculated by multiplying the number of equivalent full time teaching staff (of all classifications) of the school by 1.5.
S2.6.2.2 Each primary school will appoint employees to leadership positions as in S2.6.2.1 above but the multiplier will be 1.0 in lieu of 1.5
S2.6.2.3 For the purposes of this clause a primary school will be deemed to be a school or a section of a school which offers courses of instruction up to and including year 7 and a secondary school will be a school or section of a school which offers courses of instruction for students beyond year 7.
S2.6.2.4 Where a school is separated into different sections each section will be considered as a separate school and leadership points will be appointed in each section of the school according to the prescribed leadership position points determined by the number of equivalent full time teaching staff employed in that section of the school.
S2.6.2.5 Prescribed leadership points will be utilised as follows:

For each Band 2 level 3 appointment

4.

For each Band 2 level 4 appointment

13 points

S2.6.2.6 Points will be expressed as integers only but where the prescribed leadership points are not divisible, then the total of prescribed leadership points will be increased by one to enable division.


S2.6.2.7 Prescribed leadership points will be calculated on the actual equivalent full time teaching staff (of all award classifications) of the schools as at 1 February each year.
S2.6.3 Tenure
S2.6.3.1 Subject to other provisions of this Award the minimum period of tenure of Leadership

Position appointments will be as follows:

S2.6.3.2 During the school term preceding the expiration of tenure an employee may request an appraisal from the Principal. The Principal must provide details of the appraisal process. If an appraisal is requested then the employee must be provided with a written summary of the findings.


S2.6.3.3 An employee whose classification in a Leadership Position expires and who is not re- appointed will revert to the appropriate step on the Band 1 incremental scale.
S2.6.4 Simultaneous Appointments
S2.6.4.1 An employee must not simultaneously be appointed to more than one Leadership Position.
S2.6.5 Duty Statements
S2.6.5.1 Employees appointed to a Leadership Position will have an agreed duty statement setting out:
1. the classification level
2. the local title of the position (if applicable)
3. the salary and allowance to be paid
4. the duties to be carried out
5. the length of tenure of the position
6. the provision of additional non-contact time (if any).
S2.6.6 Transition Provisions
S2.6.6.1 Employees who on 31 January 1994 were classified as Senior Teachers or Special Senior Teachers and paid the salary applicable to that classification will be paid their former salary quantum until their rate of total remuneration is equalled or exceeded by the Band 1 Step 10 salary in Schedule 1.
S2.6.6.1.1 These employees will have the benefit of State Wage Case salary adjustments of general application.
S2.6.6.1.2 In 1994 prescribed leadership position points will be offset by 9 points for each former Senior Teacher appointment and by 13 points for each former Special Senior Teacher appointment where employees who held those former positions continue to be employed at the school but are not appointed, or do not accept appointment, to a Leadership position.
S2.6.6.1.3 In successive years the number of points offset will be reduced by one point each year until such time as there are no points left to be offset or until holders of these former positions cease to be employed at the school.
S2.6.6.1.4 Employees referred to in this sub-clause will be eligible to apply for Advanced Skill Teacher classification but will not be eligible to receive the additional salary pertaining to that classification until their own salary is equalled or exceeded by the salary for an Advanced Skill Teacher.
S2.6.6.2 Employees who on 31 January 1994 were classified as Senior or Special Senior Teachers and who are appointed to a classification the salary for which is less than the employees current salary will be paid their former salary quantum until equalled or exceeded by the salary pertaining to their new classification.
S2.6.6.2.1 These employees will have the benefit of State Wage Case salary adjustments of general application.
S2.6.6.3 Employees who on 31 January 1994 were classified as a Senior Teacher and who are subsequently appointed to a Band 2 Level 3 or Level 4 position will be bound by the provisions of this award pertaining to that classification.
S2.6.6.4 Employees who on 31 January 1994 were classified as a Special Senior Teacher and who are subsequently appointed to a Band 2 Level 4 position will be bound by the provisions of this award pertaining to that classification.
S2.6.6.5 Employees who on 31 January 1994 were paid an allowance pursuant to clause 1.3 of Schedule 1 will, from 1 February 1994, either be classified as Band 2 teachers and be bound by the provisions of this award pertaining to that classification or will continue to undertake duties subject to the provisions of clause 1.3 Schedule 1. However, no employee must experience a reduction of remuneration due to the operation of this clause.
S2.6.6.6 Employees who immediately prior to 25 August 1993 were classified in a position of responsibility, other than Senior or Special Senior, will not be eligible to be paid for classification as an Advanced Skill Teacher before 1 February 1994 unless their classification as an Advanced Skill Teacher had been approved prior to 25 August 1993.
S2.6.6.7 Employees who on 31 January 1994 were classified in another position of responsibility other than Senior or Special Senior, and who are reclassified to a Band 2 position, will not be eligible to be paid for classification as an Advanced Skill Teacher until the conclusion of their first period of tenure in the Band 2 position.
SCHEDULE 3 - ASSESSMENT CRITERIA AND PROCESS: ADVANCED SKILL TEACHER

S3.1 Band 1 teachers appointed 0.4 or greater fraction will be eligible for classification as an Advanced Skill Teacher if the teacher has not less than one full years experience at increment step 10.
S3.1.1 Applications must proceed only in the form agreed by the parties to the award.
S3.1.2 To achieve classification as an Advanced Skill Teacher an applicant must, to the satisfaction of the assessing panel, fulfil all of the assessment criteria listed under each heading below:
S3.1.2.1 Pedagogical Skills and Knowledge
1. Utilises a range of appropriate and effective teaching techniques and methodologies.
2. Consistently develops and adapts strategies to address students learning needs, problems and difficulties.
3. Consistently utilises an appropriate range of evaluation, assessment and reporting techniques.
S3.1.2.2 Professional Relationships
1. Consistently builds positive and effective relationships with students.
2. Where appropriate, collaborates with and provides support and assistance to other teachers and student teachers in the development of their teaching skills.
3. Initiates appropriate communication with parents and the wider school community.
S3.1.2.3 Professional Development
1. Demonstrates an on-going commitment to participation in professional development activities and shows how such participation has influenced his or her teaching practice.
S3.1.2.4 Curriculum Development
1. Evidences effective contribution to the development, implementation and evaluation of curriculum.
S3.1.2.5 School Community Relationships
1. Evidences application in their teaching of experiential knowledge and skills to support the fostering and sustaining of the schools philosophy.
S3.2 Processing of Applicants
S3.2.1 Each application will be lodged by the applicant with the Principal of the applicants school.
S3.2.2 On receipt of the completed application form the Principal will, within 15 school days, convene an assessment panel comprised of 2 registered teachers, one of whom (the convenor) will be the Principal of the applicants school or a nominee of that Principal. The second panellist will be called from the elected panellists of the applicants school. Where the applicant is from a school employing less than 10 FTE teachers, at the applicants discretion, the second panellist may be called from a proximate school of the same education sector respondent to this award. (See Teacher Panellists below).
S3.2.3 The panel will consider the application and the information presented by the applicant only in the context of the classification criteria and indicators specified.
S3.2.4 The panel, in its proceeding and decision, will be governed by equity, good conscience and the substantial merits of the application without regard for technicalities or legal forms.
S3.2.5 After its consideration of the written application the panel will:
S3.2.5.1 By consensus resolve that the employee be classified as an Advanced Skill Teacher, or
S3.2.5.2 Resolve to require the applicant within 5 school days to attend for interview and to supply further and better particulars as a panellist may reasonably require, and then direct the teacher be classified as an Advanced Skill Teacher, or
S3.2.5.3 After proceeding initially as in S3.2.5.2 above, resolve to decline the application. In this event, the panel will, within 5 school days, provide to the applicant written reasons for the decision and will inform the applicant that he or she may either make further application no earlier than 1 year hence or within 10 school days lodge an appeal in the manner prescribed in this Schedule at S3.3.
S3.2.5.4 Following its assessment the panel will supply a copy of the application including the panels decision in the matter, to the employer and the applicant and the employer will commence payment of the appropriate salary on and from the first full pay period occurring after the date of the decision.
S3.3 Appeals
S3.3.1 An applicant aggrieved at the panels determination may appeal against that decision.
S3.3.2 Appeal applications will be in writing to the convening employer detailing the grounds of the appeal. The only grounds for appeal are:
1. That the panel failed to observe the prescribed process, and/or
2. That the panel manifestly erred in assessing a particular merit of the application. S3.3.3 The onus of proof rests on the applicant.
S3.3.4 An appeal will proceed by way of review of the original application and in the manner prescribed at clause S3.2 above. However, persons responsible for the initial adjudication will not be eligible to be empanelled. In addition, the appeal panel shall be supplemented by a third person who, as a panellist, will be mutually acceptable to the applicant and to the employer.
S3.3.5 A majority decision of an appeal panel will constitute the final determination of an application.
S3.4 Teacher Panellists
It is recommended that school teaching staff elect annually two or more teachers willing to serve on panels for Assessment of Advanced Skills Teacher applications and appeals. It is recommended that the panellists serve in strict rotation.
