SUMMARY

Veaceslav Untilă, Doctor of Law.

Born on the 15th of June 1956, in the village of Codreanca, Chisinău district.

Education: School of Mechanics of the Technical University of Moldova and the Law School of the State University of Moldova. He received his Doctor degree within the Institute of Philosophy, Sociology and Law of the Academy of Science of Moldova.

Since 1978 he works in the Ministry of Internal Affairs of the Republic of Moldova. During the period of 1992-1995 he is head of the Highway.

Police Department; during 1995–1998 he is Chairman of the Administrative Council of International Organization of Traffic Control, with the headquarters in Geneva. At the same time with his diplomatic work he develops an important scientific activity, creates a comprehensive study concerning the problems of fighting the organized crime.

In Geneva, Veaceslav Untilă prints the work in three volumes: „Services, Studies, Consulting And Information On The Issues Of Fighting Criminality In Cases Of Theft And Driving Away Of Vehicles“. He is the author of a large number of scientific works in this field. His large work experience and knowledge acquired have determined him to write the present book with a deep professional understanding where his ideas, thesises and conclusions are of a considerable practical use.

The thesis is dedicated to the study of one of the most widespread types of crime – theft and driving away of motor transport. The problem has been studied at two levels – national and international. A special attention is given to the examination of topical questions of the organized criminality with regard to its notion, typical signs, state, dynamics and evolutionary tendencies. On one hand, this approach enabled to make the general notion of organized criminality more accurate, and on the other hand, to develop the system of criteria typical for such form of criminal activities as the infringement upon motor transport. The general conclusion has been made, that this class of criminal phenomena represented the special type of criminal activities, which proceeded at both national and international levels.

The separate sections of the thesis are dedicated to the study of each level of criminal activities of the organized criminal groups. Especially are described: the driving away and theft of vehicles as a component part of organized criminality; social and economical conditions favorable for growth of this form of crime; organizational aspects of criminal groups; goals and specific character of motor transport driving away and theft’s concealment; specific forms of this type of international criminality, problems of return of vehicles to their legal owners e.t.c.

The issue of national and international programs on car theft prevention are examined in the thesis.

The specific character of car theft prevention being based on national legislation is studied in countries of West, Central and East Europe, USA.

The data given by national and international statistics, the results of national and international research in sociology and other actual informational materials are widely used in the thesis.

Вячеслав Унтилэ, доктор права.

Родился 15 июня 1956 года в селе Кодрянка уезда Кишинэу.

Образование: механический факультет Технического Уни­вер­­ситета Молдовы и юридический факультет Госуни­верситета.

Закончил аспирантуру в институте философии, социоло­гии и права при Академии наук.

С 1978 года работает в Министерстве внутренних дел. С 1992 по 1995 являлся начальником республиканской дорож­ной полиции. С 1995 по 1998 – председатель Администра­тив­но­го Совета международной организации дорожного движе­ния в Женеве.

В настоящее время является вице-министром внутренних дел республики.

Совмещал дипломатическую деятельность с научно-ис­следо­ва­тельской работой в области борьбы с организованной преступностью на международном уровне. Под его редакцией в Женеве вышло в свет трехтомное издание посвященное проблемам борьбы с угоном и кражей автотранспорта. Являет­ся автором десятков научных публикаций по данной тематике. Богатый трудовой опыт, накопленные знания позволили ему написать данную книгу с профессиональной компетентнос­тью. Тезисы, идеи и заключения автора имеют огромное прак­ти­ческое значение.

Книга посвящена исследованию одного из наиболее распространенных видов преступлений – краж и угонов автотранспортных средств. Разработка проблемы проведена на двух уровнях: национальном и транснациональном. Особое внимание уделено рассмотрению актуальных вопросов орга­ни­зованной преступности, касающихся ее понятия, характер­ных признаков, состояния, динамики и эволюционных тенден­ций. Благодаря такому подходу представилось возможным, с одной стороны, уточнить общее понятие организованной прес­туп­ности, а с другой, - развить систему критериев, вы­ра­жа­ющих особенности такого вида организованной преступ­ной деятельности, как посягательства на автотранспортные средства. Сделан общий вывод, что такого рода криминальные явления представляют собой специализированный вид органи­зованной преступной деятельности, которая имеет место на национальном и международном уровне.

Отдельные разделы работы посвящены исследованию каж­дого из названных уровней криминальной деятельности ор­гани­зованных преступных групп. В частности, охаракте­ризо­ваны кражи и угоны транспортных средств как составная часть организованной преступности, социальные и эконо­ми­чес­кие условия роста данного вида преступлений, органи­зация, цели и специфика сокрытия краж и угонов автотран­спорта, особенности международной преступности данного вида, проблемы возврата автотранспортных средств и другие. Подвергнут анализу вопрос о межгосударственных и меж­ду­на­родных программах противодействия криминальному обо­ро­ту автотранспортных средств.

Рассмотрены особенности борьбы с кражами и угонами автотранспорта в странах Восточной, Центральной и Западной Европы, США и борьбы с ними на основе национального законодательства. В работе широко использованы данные меж­дународной и национальной статистики, проведен­ных международных социологических исследований и другие фактические материалы.
