List of Duties / Responsibilities being discharged

in MTO Branch at DGS:


  1. On line processing of applications for registration as “Multimodal Transport Operator (MTO)" with Director General of Shipping, as Competent Authority, under Multimodal Transportation of Goods (MMTG) Act, 1993




  1. On line processing of applications for renewal of registration as “Multimodal Transport Operator (MTO)".




  1. Scrutiny and processing of the applications received for Change of name / address of MTO on the certificate of Registration




  1. Issuance of Duplicate certificate / additional copies of certificate of Registration as 'MTO'.




  1. Dealing with complaints or VIP references relating to handling of goods in EXIM trade and Analysis of complaints received at DGS during previous years.




  1. Study of the proposals for draft amendment to MMTG Act and their submission for approval of DG(S) and Ministry of Shipping thereafter. Handling subsequent references, thereafter, or preparation of Power Point Presentation for the same.




  1. Holding discussions with officials of AMTOI and other trade bodies/associations for fine tuning / new formulation of amendment proposals to MMTG Act, 1993 or any of the rules there under.




  1. Accounting of the fees received in MTO Branch and handing over thereafter to F&A Branch for crediting in the bank account of DGS.




  1. Collation of information from trade association (INSA / AMTOI ) and organisations (SCI) / Govt bodies (RBI, CBEC) on points raised at various forums or references received from Ministry of Shipping / DG Shipping in respect of Carriage of Goods by Sea Act, 1925, MMTG Act, 1993 etc.




  1. Conveying / arrangement for Personal Hearing (PH) post issuance of 'Show Cause Notice' (SCN) to MTOs and handling of correspondence thereafter.




  1. Maintaining all updated rules under MMTG Act, 1993 on website of DGS, List of approved and valid MTOs (Also including analysis of time taken for approval) & invalid MTOs for the benefit of trade.




  1. Handling calls and e-mails received and replying them at DGS in relation to registration/renewal aspects MTO.

Note 1: Acknowledgment of application: On submission of an application to the office of DGS, “acknowledgment of application” will be issued to the applicant, at the reception. “Acknowledgment of application” shall not be treated as “receipt of application”.

Note 2: Receipt of application: On submission of complete application to the office of DGS, along with all the documents depicted in any of the above applicable check-lists, a “receipt of application” will be issued to the applicant, in person, on the third working day, meaning thereby, only if all the enclosures of application are complied with. Thereafter, application shall be disposed off within maximum 60 days.

Note 3: Incomplete Application: Application with incomplete enclosures, i. e. which are not as per the applicable check-list, will be returned to the applicant indicating discrepancies, in person / by post. For this purpose, the visit to the office may be coordinated basis availability of the concerned officer / ADG telephonically.

Note 4: Stages of processing within DGS: Application with complete enclosures, i.e. which is as per the applicable check-list, will be initially processed by Dealing Assistant of the MTO branch of DGS & then will be forwarded to concerned ADG / DDG who then recommends to Jt. DG/ Competent Authority for granting of a certificate of registration as MTO. On approval, an e-mail is generated by e-governance system for communication of approval to the applicant. When applicant submits a copy of insurance and a specimen of MTD to DGS, a certificate of registration is issued to applicant along with returning of the original certificate of insurance. Thereafter, the names of MTOs are updated on the website www.dgshipping.gov.in / Shipping Notices / MTO, on quarterly basis,

ADG (MTO Branch) issues its receipt if submitted as per check-list and processes or returns back, within 3 days, to applicant for want of enclosures.

ADG (MTO Branch) issues certificate of registration, within 60 days with original insurance to applicant.



MTO.

DDG (MTO) recommends for approval, within 30 days.

When Competent Authority approves, approval of application is issued by e-mail.

On receipt of mail, applicant submits original insurance & MTD as per check list to DGS.

Annexure – I



Check list: Annexures to Application for Registration as “Multimodal Transport Operator (MTO)” :


Annex 1: Form I, printout of on-line application with applicable fees, INR 10000/- by a DD/PO/NEFT, in favour of the D. G. Shipping, Mumbai.

Annex 2: Certificate from C.A. showing Annual Turnover of the applicant for the preceding three financial years OR subscribed & paid-up share capital / aggregate balance in the capital account along with Income Tax Returns (front page) for the preceding three financial years.

Annex 3: Complete audited accounts of the applicant, including auditors report, all schedules and notes to the accounts for the preceding financial year.

Annex 4 & 5: Copies of agency agreements, reflecting multimodal operations of the applicant with two agents (from two different foreign countries), reflecting the date of such agreement with (visible) signature and stamp AND confirmation of the validity of these agreements from the same foreign agents. The Agreements must cover the following:

“Applicant should act as a “Principal” for taking charge of goods for exports from India and the foreign counterpart will act as “agent” for multimodal transportation when a MTD is issued for exports from India.”

Annex 6: A Certificate of Incorporation with a copy of the Memorandum and Articles of Association, if the applicant is a company OR registration under Partnership Act OR registered deed of proprietorship AND documentary proof reflecting the registered office address of the applicant / presence in India.

Annex 7: Name/s of all the Directors / Partners / Proprietor of the applicant with their contact details in India.

Annex 8: List of offices, with key staff who will be authorized signatories to sign the Multimodal Transport Documents (MTDs) with their names, designation and specimen signature, in original duly authenticated by CEO on the letterhead of applicant AND proof of their employment, viz. PF returns OR the Tax Deducted at source on salaries.

Annex 9: An undertaking on the applicant’s letter head with signature of responsible person, for to issue MTD for taking charge of goods for exports from India [as prescribed by the DGS].


Documents to be submitted within 30 days, by applicant after receipt of approval (on their given e-mail ID), [failing which, registration will be deemed as invalid]:

1. Specimen of MTD (in the format to be downloaded from www.dgshipping.gov.in / shipping notices / MTO, for printing) with the registration number, name of applicant with full address and the contact details in India (telephone, website, e-mail etc.).

2. Original Insurance cover for all liabilities as per MMTG Act, 1993. (To be returned by this office after verification)

3. Acceptance of the terms of approval of registration (as given in approval by email).

Annexure – II

Check list: Annexures to Application for Renewal of Registration issued to “Multimodal Transport Operator (MTO)” :

Annex 1: Form III, printout of on-line application with fees INR 10000/- or INR 20000/- as applicable, by a DD/PO/NEFT, in favour of the D. G. Shipping, Mumbai [with the original certificate of registration,].

Annex 2: Few copies of MTD issued after registration as MTO and copies of insurance for MTO liability (previous two).

Annex 3: Certificate from C.A. showing Annual Turnover of the applicant for the preceding three financial years OR subscribed & paid-up share capital / aggregate balance in the capital account along with Income Tax Returns (front page) for the preceding three financial years.

Annex 4: Complete audited accounts of the applicant, including auditors report, all schedules and notes to the accounts for the preceding financial year[Optional].

Annex 1: Request letter with original certificate of registration as MTO & applicable fees INR 5000/- by a DD/PO/NEFT, in favour of the 'D. G. Shipping, Mumbai',
Annex 2: Specimen (blank & cancelled) copy of Multimodal Transport Document (MTD) with the required changes in name or address,
Annex 3: A copy of the Form 18 filed with ROC for effecting changes, if the applicant is a company, with Certificate of Incorporation OR Registration under Partnership Act OR registered declaration of the deed of proprietorship with documentary proof reflecting the revised name or registered office address of the applicant / presence in India.
Annex 4: A copy of insurance certificate after effecting the required changes therein,
Annex 5: List of authorised signatories to sign MTD with their names, designation and specimen signature, in original duly authenticated by CEO on letter-head of applicant with the required changes in name or address.
