2 Establishment of Rules Board for Courts of Law


There is hereby established a board called the Rules Board for Courts of Law and having the powers and duties conferred or imposed upon it by this Act or any other law.
6 Powers of Board
(3) Rules made under any provision of a law repealed by this Act and in force at the commencement of this Act, shall, subject to the provisions of this Act and notwithstanding the repeal of that provision by section 10 or 11 of this Act, remain in force until amended or repealed under this section.
(4) No new rule or amendment or repeal of a rule shall commence unless it was published in the Gazette at least one month before the day upon which such rule, amendment or repeal is determined to commence.
(5) Every rule and every amendment or repeal thereof shall within 14 days after it commenced be laid upon the Table in Parliament if Parliament is then in session, or if it is not then in session, within 14 days after the commencement of its next ensuing session.

26. Establishment, composition and appointment of Appeal Board
(1) There is hereby established an independent board known as the Appeal Board to hear and decide upon appeals against decisions made in terms of this Act.

(2) The Appeal Board consists of at least seven members appointed by the Minister on the advice of the National Assembly.


30. Removal of member and dissolution of Appeal Board
(1) The Minister must remove a member of the Appeal Board from office on account of misconduct or inability to perform his or her duties efficiently after due inquiry and upon recommendation by the National Assembly.

(2) (a) The National Assembly may, after due inquiry and by the adoption of a resolution, recommend the removal of a member of the Appeal Board from office on account of any or all of the following:

(i) Misconduct;

(ii) inability to perform the duties of his or her office efficiently;

(iii) absence from three consecutive meetings of the Appeal Board without the permission of the Appeal Board, except on good cause shown;

(iv) failure to disclose a conflict of interest in a matter heard by the Appeal Board or participation in proceedings of the Appeal Board while having an interest in the matter heard by the Appeal Board; or

(v) his or her becoming disqualified as contemplated in section 34.

(b) The National Assembly may, after due inquiry and by the adoption of a resolution, recommend the dissolution of the Appeal Board if it fails in discharging its duties in terms of this Act.

(3) The Minister—



(a) may suspend a member of the Appeal Board from office at any time after the proceedings of the National Assembly for the removal of the member have commenced;

(b) must act in accordance with a recommendation contemplated in subsection (2) within 30 days of receipt by the Minister of that recommendation;

(c) must dissolve the Appeal Board if the resolution of the National Assembly recommends the removal of all the members of the Appeal Board.
31. Appointment of interim Appeal Board
(1) (a) Upon the dissolution of the Appeal Board, the Minister must appoint an interim Appeal Board consisting of a person referred to in section 26(4) and three other persons recommended by the National Assembly.

(b) The interim Appeal Board must be appointed within 10 days of receipt of the recommendations of the National Assembly by the Minister and is appointed for a period not exceeding six months.
41. Report of Appeal Board
The Appeal Board must annually submit to the Minister a report on the activities of the Appeal Board which must be tabled in Parliament.

34. Amendment of section 12 of Act 67 of 2001

Section 12 of the Academy of Science of South Africa Act, 2001, is hereby amended—



(a) by the substitution for subsection (2) of the following subsection:
‘‘(2) The financial statements must be submitted to [members] Members within six months of the end of the financial year.’’; and

(b) by the addition of the following subsections after subsection (2):
‘‘(3) The Academy must submit to the Minister the financial statements referred to in subsection (1) and such other particulars as the Minister may require within six months of the end of the financial year.
(4) The Minister must table the financial report referred to in subsection (3) in Parliament.’’.
48. Amendment of section 16 of Act 68 of 2001

Section 16 of the Africa Institute of South Africa Act, 2001, is hereby amended—



(a) by the substitution for subsection (1) of the following subsection:
‘‘(1) The Auditor-General must audit the accounts and balance sheet of the [Council] Institute.’’;

(b) by the substitution for paragraph (a) of subsection (2) of the following paragraph:
‘‘(a) furnish the Minister with such information as he or she may call for

in connection with the activities and financial position of the [Council] Institute; and’’; and


(c) by the substitution for subsection (3) of the following subsection:
‘‘(3) The Minister must table the report referred to in subsection (2)(b) in Parliament [within 14 days after receipt thereof if Parliament is in session or, if Parliament is not in session, within 14 days after commencement of its next session].’’.

2 Continued existence of Councils for Scientific and Industrial Research


(1) The Council for Scientific and Industrial Research established by section 2 of the Scientific Research Council Act, 1945 (Act 33 of 1945), shall, notwithstanding the repeal of the Scientific Research Council Act, 1984 (Act 82 of 1984), by this Act, continue to exist as a juristic person known as the CSIR.
7 Control over, and management of affairs of, CSIR
(1) The affairs of the CSIR shall be managed by a board, which shall determine the policy and objectives of the CSIR and shall exercise control generally over the performance of its functions, the exercise of its powers and the execution of its duties by the CSIR.
14 Auditing and annual report
(1) The Auditor-General shall audit the accounts and balance sheet of the CSIR.
(2) (a) The Board shall furnish to the Minister such information as he may call for from time to time in connection with the activities and financial position of the CSIR, and shall in addition submit to the Minister an annual report, including a balance sheet and a statement of income and expenditure certified by the Auditor-General, an estimate of expenditure in respect of the following financial year, and such other particulars as the Minister may require.
(b) The Minister shall lay the said report on the Table in Parliament within 14 days after the receipt thereof, if Parliament is in ordinary session, or, if Parliament is not in ordinary session, within 14 days after the commencement of its next ensuing ordinary session.
